2022: Initiation of criminal proceedings after the death of a 26-year-old woman in labor and her child

On December 21, 2022, the Investigative Committee of Russia announced the initiation of a criminal case after the death of a 26-year-old woman and her child in a maternity hospital in Chelyabinsk. We are talking about Part 2 of Art. 109 of the Criminal Code of the Russian Federation - causing death by negligence due to improper performance of professional duties.

The course of the investigation took control of the central office of the department. The head of the Investigative Committee, Alexander Bastrykin, instructed the leadership of the Investigative Directorate of the Investigative Committee of the Russian Federation in the Chelyabinsk Region to report on the events taken.

The tragedy occurred on December 16, 2022. Daria felt bad, the temperature rose. A woman who was 38 weeks pregnant was taken to the maternity ward of the city hospital No. 9 by ambulance. For a while, she still got in touch with her relatives, and then stopped answering calls. Eight hours later, the woman died in the hospital. They could not save her child either.

The girl's relatives appealed to the Investigative Committee of the Russian Federation. They believe that the negligence of doctors led to the tragedy, and asked Bastrykin to monitor the investigation so that the perpetrators would not evade responsibility.

The Ministry of Health of the Chelyabinsk Region said that the case of death was associated with the development of a sudden uncontrolled complication of pregnancy. Doctors took comprehensive measures, assistance was provided in full, and treatment was carried out in accordance with the diagnosed complication and concomitant ARVI, the department said.

For causing death by negligence due to improper performance by a person of his professional duties (part 2 of article 109 of the Criminal Code of the Russian Federation), various options for punishment are provided - from restriction of freedom and forced labor to imprisonment for 3 years.[1]
