2022: The Ministry of Health of Chuvashia was convicted of collusion with the DRG Tekhsystems
The Commission of the Office of the Federal Antimonopoly Service for the Chuvash Republic (OFAS) considered the information of the Investigative Department of the Investigative Committee of Russia for the Chuvash Republic and recognized the regional Ministry of Health and ZAO DRG Tekhsystems as having violated paragraph 1 of part 1 of article 17 of the Law on Protection of Competition. The press service of the republican OFAS announced this on December 23, 2022.
According to the regulator, the Ministry of Health of the Chuvash Republic and the DRG Tekhsystems company entered into and implemented an agreement that aimed to create preferential conditions for participation in the auction for the company. When making a purchase for the supply of a medical device - a linear accelerator system, commissioning a medical device, training in the rules of operation of specialists operating a medical device intended for the Republican Clinical Oncological Dispensary AU, the ministry established in the auction documentation the conditions prepared by the company's representative.
The tender was won by DRG Tehsystems CJSC with a Varian Clinac iX accelerator assembled at the RTT Factory facilities and a tomograph from GE Healthcare for 324 million rubles. The terms of the competition caused complaints from market participants - in their opinion, the accelerator parameters and the inclusion of the ExacTrac system in the procurement list limited the number of procurement participants.
In addition, during the procurement period, the customer vested the company's representative with the right to participate on behalf of the ministry in the consideration of a complaint by a potential auction participant in the Chuvash OFAS of Russia, who pointed to the requirements of the terms of reference restricting competition.
The concluded agreement led to limited competition and a decrease in the number of procurement participants, - said the acting deputy head Anna Shevchenko.[1] |
