Department of state property and land relations of Zabaykalsky Krai No. 115 "About the temporary system and structure of executive bodies of the government of Zabaykalsky Krai and a time structure of the supreme executive body of the government of Zabaykalsky Krai" is formed according to the resolution of the Governor of Zabaykalsky Krai of June 27, 2008 No. 136 "About measures for implementation of the resolution of the Governor of Zabaykalsky Krai of June 05, 2008 and is the executive body of the government of Zabaykalsky Krai exercising branch and cross-industry management in the field of:

• the execution of the powers delegated by the Russian Federation on management and the order of the land plots, other real estate units which is in federal property;

• property and land relations of Zabaykalsky Krai.

The department is authorized body in the field of differentiation and redistribution of the state-owned and municipal property.

On September 30, 2008 the Government decree of Zabaykalsky Krai No. 39 approves Regulations on Department of state property and the land relations of Zabaykalsky Krai.

The history of creation and activity of Committee on state property of the Chita region

1991

For the purpose of creation of necessary legal and organizational conditions for regulation of the relations of property, carrying out privatization of state property, development of new forms of managing, differentiation of control functions by the state enterprises and organizations in the territory of the Chita region, according to requirements of the Law of RSFSR of July 03, 1991 No. 1531-1 "About privatization of the state and municipal enterprises in RSFSR" the decision of the Chita regional council of People's Deputies of the XXI convocation (the eighth session) of October 03, 1991 formed the Property management committee of the Chita region and also the Provisional regulations for it are approved.

At the initial stage Property Management Committee of the Chita Region headed work on creation of municipal property management committees, performed development of methodical materials on differentiation and privatization of state-owned property, held seminars, meetings, consultations with heads of areas of the Chita region, chairmen of municipal property management committees, heads of the enterprises for questions of differentiation and the forthcoming privatization of state property, created lists of the state objects, privatizeable, together with district administrations prepared and sent to the State Property Committee of Russia the documents necessary for holding a procedure of differentiation of state-owned property in the territory of the Chita region.

1992 – 1996.

In pursuance of the order of the Government of the Russian Federation of January 29, 1992 No. 52 "About acceleration of program implementation of privatization for 1992", the order of the State Committee of the Russian Federation on management of state property of March 26, 1992 the No. 35 Management committee of state property of the Chita region it was given authority of territorial agency of the State Committee of the Russian Federation on management of state property.

In November, 1992 with the assistance of Management committee the state property of the Chita region formed the public institution performing functions of the seller of state property - Fund of property of the Chita region with which activity of Committee for 9 years was closely connected.

According to the requirement of the current legislation on December 17, 1992 the resolution of the Head of administration of the Chita region No. 469 approved Regulations on the Property management committee of the Chita region – executive authority of the Chita region, the territorial agency of the State Committee of the Russian Federation on management of state property having rights and powers on management and the order of state property of the Chita region and state property of the Russian Federation, located in the territory of the Chita region.

At this stage Committee performed activities for differentiation of the rights to objects of state-owned property, commercialization of the state enterprises and associations, took part in development of State programs of privatization, in high gear performed check privatization of the state property located in the territory of the Chita region, through mass media explained to the population state policy in the field of privatization of property. With active participation of the Property management committee of the Chita region there was a formation of security market, mechanisms of its state regulation were fulfilled: a large number of business entities, investment institutes was established, state registration of share issues was performed, transactions with securities were conducted, public servants represented the interests of the Chita region and the Russian Federation in management and supervisory bodies of business entities from shares of the state participation.

1996 - 1998.

During the specified period decrease in rates of privatization was observed, check privatization of state-owned property came to the end.

The main work of the Property management committee of the Chita region was directed to privatization of objects of state-owned property for money, professional participation of the state in governing bodies of business entities, state regulation of security market, delivery of the state objects in lease, transfer to the municipal property of the buildings for social, cultural and household purposes which did not enter authorized capitals of the joint-stock companies founded in the course of privatization, issue of licenses for implementation of realtor activity and control of observance by licensees of requirements of the legislation.

1998 - 2001.

Since April 01, 1998 the Property management committee of the Chita region performed powers on management and the order of the federal property located in the territory of the area within the Agreement signed between the Ministry of state property of the Russian Federation and the Head of administration of the Chita region.

On April 16, 1998 the resolution of the Chita region duma the No. 111 Property Management Committee of the Chita Region it was renamed into Management committee by state property of the Chita region.

The Government of the Russian Federation, Administration of the Chita region reviewed the principles and priorities in the field of management and the order of state property. The new principles were stated in the Management concept by state property and privatizations in the Russian Federation approved by the order of the Government of the Russian Federation of September 09, 1999 No. 1024 and in the Management concept state property and privatizations in the Chita region approved by the resolution of the Head of administration of the Chita region of February 22, 2000 No. 123.

In pursuance of the specified Concepts the resolution of the Head of administration of the Chita region of December 15, 1999 No. 1294 approved new edition of Regulations on Management committee by state property of the Chita region according to which activity of Committee were is directed to creation and improvement of a management system for state-owned property, optimization and increase in efficiency of public sector of economy.

At this stage the main work of Committee was connected with carrying out continuous inventory and accounting of state-owned property, state registration of the rights of the Russian Federation and the Chita region to the state real estate, formation of the single database of state property, privatization of the released military property, gain of control of effective use by asset holders of objects of state-owned property and results of financial and economic activity of the state unitary enterprises, involvement of not used state objects in economic circulation, issue of licenses for implementation of estimated activity, control of observance by licensees of requirements of the legislation on estimated activity.

2001 – 2003.

Due to the adoption of the Federal law of July 17, 2001 No. 101-FZ "About differentiation of state-owned property on the earth" the resolution of the Head of administration of the Chita region of September 21, 2001 No. 566 to Regulations on Management committee state property of the Chita region made changes in a part of investment of Management committee with state property of the Chita region by powers on management and the order of land resources.

On August 13, 2002 the resolution of Administration of the Chita region No. 155-A/p approved new Regulations on Management committee by state property of the Chita region in which tasks and powers of KUGI of the Chita region in the field of management and the order of state-owned property were expanded.

At this stage the main work of Committee was connected with formation of databases on the land plots, preparation of the documents necessary for differentiation of the property rights to the earth in the territory of the Chita region, development of regulatory legal acts on management and the order of state-owned property, monitoring of financial and economic activity of the state unitary enterprises, control of effective use of state-owned property, optimization of public sector of economy.

2003 - 2007.

On November 17, 2003 the order of the Ministry of the property relations of the Russian Federation No. 524 formed Territorial Department of the Ministry of the property relations of the Russian Federation for the Chita region – the federal executive authority given the rights of management and the order of the property of the Russian Federation in the territory of the Chita region. With respect thereto the Property management committee of the Chita region lost powers on management and the order of federal property.

Since the specified moment of a task of the order and management of the state property which is in the territory of the Chita region decide two state bodies of executive power which activity is closely interconnected: Management committee state property of the Chita region – the executive authority of the Chita region performing powers on management and the order of regional property, and Territorial Department of the Federal agency on management of federal property for the Chita region – the federal executive authority performing powers on management and the order of federal property.

Due to the abolition in 2004 of Federal service of Russia on financial improvement and bankruptcy the Management committee state property of the Chita region was given authority on financial improvement and bankruptcy in a part: the directions of the petition in arbitration court for introduction (prolongation) of external control concerning the city-forming organization; determinations of requirements to the candidate for the external administrator and the direction them in self-regulatory organizations of arbitration managers at submission of the guarantee according to obligations of the debtor - the city-forming organization; acceptances of timely measures on warning of bankruptcy of the state unitary enterprises; representations of legitimate interests of the Chita region when carrying out insolvency proceedings concerning the state unitary enterprises and business entities from shares of the state participation of the Chita region and participation in creditor meetings of data of the enterprises, in court sessions.

According to order of the Governor of the Chita region since 2004 in Committee began to be engaged actively in work on identification in the territory of the Chita region of the ownerless and thrown real estate and to their involvement in economic circulation.

In 2006 implementation of the priority national projects "Affordable and Comfortable Housing — to Citizens of Russia", "Development of Agro-industrial Complex", "Education" and "Health" is begun. The basis for the solution of the imminent problems of quality improvement of education, improvement of health of the population, providing citizens with affordable and comfortable housing, formations of worthy living conditions in the village and development of agro-industrial production is created.

The corresponding normative and substandard legal acts of the Government of the Russian Federation, federal and regional target programs were the basis for implementation of priority national projects. The successful embodiment of these regulations in life would be impossible without their strict execution by public authorities and local government therefore by the resolution of Administration of the Chita region of October 10, 2006 No. 260-A/p "About the organization of work on transfer of material values within priority national projects in the field of health care and education" it was established that authorized executive body of the government of the Chita region on acceptance in the property of the Chita region and transfer into the ownership of municipal entities of material values within priority national projects in the field of health care and education is the Management committee state property of the Chita region.

With active participation of Committee such material values as the medical equipment, machines of emergency medical service, reanimobiles, diagnostic means, antiretroviral medicines, expensive medicines, buses for educational institutions, the educational and educational and evident equipment came to regional property. Receivers of the specified material values were the public and municipal authorities of health care and education.

On October 3, 2006 the order of Administration of the Chita region No. 670-A/r it was approved Management concepts by state property of the Chita region until 2009, offered by Management committee state property of the Chita region. Since the specified moment activity of Committee is directed to step-by-step reduction of excess state property of the Chita region which does not provide accomplishment of the state powers (functions), implementation of new management model with state property of the Chita region founded on the principle of strict compliance of structure of regional property to the state powers (functions)

During the specified period a number of regional target programs are also developed and implemented by Management committee state property of the Chita region: "Development of a system of state registration of the rights to real estate and transactions with it in the Chita region for 2002-2006" (it is approved as the resolution of Administration of the Chita region of 12/17/2002 No. 308-A/p); "Information support of real estate administration, reforming and regulation of the property relations" of the regional target program "Creation of an Automated System of Maintaining State Land Cadastre and State Accounting of a Real Estate (2003-2007)" (it is approved as the resolution of Administration of the Chita region of August 16, 2002 No. 154-A/p); "Market development of securities in the territory of the Chita region (2006-2008)" (it is approved as the resolution of the Governor of the Chita region of February 28, 2007 No. 16).

2008.

Since February 01, 2008 according to the Law of the Chita region of November 21, 2007 No. 1046-ZChO "About establishment of power of Administration of the Chita region according to the order the land plots in the territory of the city of Chita" to Administration of the Chita region delegate powers according to the order by the land plots in the territory of the city of Chita on which state-owned property is not differentiated.

The resolution of Administration of the Chita region of January 21, 2008 No. 10-A/p "About some powers of Management committee state property of the Chita region" authorized executive body of the government of the Chita region by the order the land plots in the territory of the city of Chita on which state-owned property is not differentiated, determines Management committee by state property of the Chita region.

History of Department of state property of the Agin-Buryat Autonomous Okrug

On December 11, 1991 the decision of Council of People's Deputies of the Agin-Buryat Autonomous Okrug of the XXI convocation (the ninth session) creates Management committee by state property of the Agin-Buryat Autonomous Okrug. Since the beginning of creation the Committee performed function of fund of property of the Agin-Buryat Autonomous Okrug. On the basis of the order of the Ministry of state property of the Russian Federation No. 67 of 4/16/1999 to committee powers of territorial authority of the Ministry of state property of the Russian Federation according to the Agreement on obligations of the Ministry of state property of the Russian Federation and the Head of administration of the Agin-Buryat Autonomous Okrug were delegated. The order of the Ministry of the property relations of the Russian Federation No. 608 of 12/22/2003 forms Territorial Department of the Ministry of the property relations of the Russian Federation for the Agin-Buryat Autonomous Okrug.

On November 08, 2005 the order of the Head of administration of the Agin-Buryat Autonomous Okrug No. 545 "About reorganization of executive bodies of the government of the district" forms Department of state property of the Agin-Buryat Autonomous Okrug which is a legal successor of Management committee state property across the Agin-Buryat Autonomous Okrug.
