2023: Conversion of shares to state revenue
In January 2023, the Khamovnichesky Court of Moscow satisfied the claim of the Prosecutor General's Office to appeal to the state for part of the shares (about 92.4%) of the Far Eastern Shipping Company (Fesco group).
As RIA Novosti reported on January 11, 2023, the meeting lasted from early morning. Until late in the evening, the defendants filed motions, but almost all the judge rejected. Consideration of the case on the merits took a couple of hours. Two lawyers called an ambulance to the court.
The defendants in court were Mikhail Rabinovich and his partner Andrei Severilov (owned 26.5% and 23.8% of Fesco shares), as well as co-owners of the Summa group, brothers Ziyavudin and Magomed Magomedov.
As defendants in the lawsuit, except for the Magomedov brothers, who, according to the verdict of the Meshchansky court, a share of 32.5% of the shares was confiscated, Smattilicious Consulting Ltd., Calamita Trading Limited, Noubelius Ltd., Enviartia Consulting Limited, Vovosa Co Limited, Rikima Holdings Limited, Mirihia Holdings Limited, Nautilius LLC and Groundinvest LLC and individuals - Mikhail Rabinovich (17.45% of DVMP PJSC), Andrey Severilov (23.8%) Sergey Bazylev (9.5%).
According to the position of the prosecutor's office, the corruption income of the brothers Ziyavudin and Magomed Magomedov was used to purchase shares in PJSC DVMP. The agency insisted that the income was received in the period from 2002-2009, when Magomed Magomedov was a member of the Federation Council from the Smolensk region. The prosecutor's office believes that it was these revenues that were legalized by businessmen by acquiring a stake in PJSC Far Eastern Shipping Company in 2012.
In December 2022, the Meshchansky Court of Moscow sentenced Ziyavudin Magomedov to 19 years in prison in the case of creating a criminal community and embezzling 11 billion rubles of budget funds. The court also confiscated the Gulfstream G650 business jet and shares of Fesco group transport assets, deprived Magomedov of state awards, imposed a two-year restriction of freedom and a fine of 2.5 million rubles.[1]
