FAS RF opened a case on Hamilton Medical due to refusal to disclose data on a possible cartel

On January 24, 2022, the Federal Antimonopoly Service (FAS) of Russia announced the establishment of a case at Hamilton Medical due to the company's refusal to disclose data on the case of maintaining prices for public procurement.

According to the press service of the regulator, he requested information from the Swiss manufacturer of medical equipment in the framework of the antimonopoly case on the grounds of cartel coordination of the actions of official distributors of Hamilton Medical with participation in public procurement for the supply of devices for artificial ventilation of the lungs (IVL). This data is necessary for the department for a full and comprehensive consideration of the case.

However, the company did not provide the requested information, and also did not send motivated explanations to the antimonopoly service about the reasons for the failure to comply with the requirements of the FAS commission, the department explained.

If guilt is established in the commission of an administrative offense, the company faces a fine in accordance with Part 5 of Art. 19.8 of the Code of Administrative Offenses of the Russian Federation (failure to submit to the federal antimonopoly authority, its territorial authority notifications provided for by the antimonopoly legislation of the Russian Federation, submission of notifications containing deliberately inaccurate information, as well as violation of the procedure established by the antimonopoly legislation of the Russian Federation and the deadlines for submitting notifications) - up to 250 thousand rubles.

In August 2021, the FAS conducted field inspections of IVL sellers. The commission found that Hamilton Medical gave instructions to distributors on how to act on public procurement. As a result of such actions, competition between suppliers was actually eliminated, which led to the division of the commodity market according to the territorial principle and the composition of buyers, as well as the maintenance of prices at the auction, indicated in the antimonopoly department.[1]
