2024: Moscow OFAS revealed the cartel in the supply of medical products worth 642 million rubles
The Moscow Department of the Federal Antimonopoly Service (FAS) disclosed a cartel conspiracy in the supply of medical devices in the amount of ₽642 million. This became known at the end of July 2024.
The Antimonopoly Service found that five companies entered into an anti-competitive agreement that covered 253 purchases. According to the FAS, LLC TK Agatmed, LLC Lifemedika, LLC Medicine-Plus, LLC Asmed and LLC Medicine and Trade entered into an anti-competitive conspiracy. The companies bid in pairs, avoiding competition and maintaining auction prices. As a result, the average price reduction for completed trading did not exceed 0.8%.
The FAS found out that the provision of participation in the auction for these organizations was carried out by a common counterparty with whom the companies entered into identical contracts for the provision of services. The activity of this counterparty was reduced to performing technical functions and supporting prices at the auction. All information was transferred to law enforcement agencies to resolve the issue of initiating a criminal case. Violators face negotiable fines in accordance with the Code of Administrative Offenses of the Russian Federation.
In June 2024, the FAS opened two cases of violation of antitrust laws against several companies that entered into an agreement at the auction for the supply of medical devices and consumables. The amount of initial maximum contract prices amounted to ₽1,141 billion. Products were required for institutions engaged in the rehabilitation of participants in the SVO.
