2025: The court recovered ₽500 thousand from the clinic for erroneous diagnosis of MRI, due to which the patient had the organ removed in vain

The patient sued the Perm medical institution Marta LLC for compensation for a medical error in decoding magnetic resonance imaging. The clinic's radiologist mistakenly diagnosed the woman with a polyp in her gallbladder and ordered surgery to remove the organ. A subsequent biopsy showed that the organ was removed in vain. The patient now requires lifelong replacement therapy. The court recovered ₽500 thousand from the medical institution. The decision was made in October 2025.

According to Medvestnik, the court admitted that the reason for the unnecessary operation was the mistake of an MRI specialist. The physician violated the method of conducting the study and misinterpreted the results. A comprehensive forensic examination confirmed the misdiagnosis.

The court ruled that the patient suffered substantial moral and physical harm. Her rights to quality medical care were violated. In favor of the woman, compensation for moral damage in the amount of ₽300 thousand was recovered. For a poorly rendered service, the clinic must pay ₽8,6 thousand. The amount of the fine amounted to ₽154,3 thousand.

The medical institution filed a cassation appeal asking for the lifting of sanctions. The clinic referred to a violation of the norms of substantive and procedural law. The Civil Bench of the Seventh Court of Cassation of General Jurisdiction considered the appeal. The collegium decided to leave the decision of the courts of previous instances unchanged.

The specialist's mistake led to serious consequences for the patient's health. The woman was removed a healthy organ without medical indications. After the operation, she needed lifelong replacement therapy. This means that the patient will be forced to take drugs throughout her life to compensate for the lost organ function.

A comprehensive forensic examination established a causal relationship between the actions of the radiologist and the consequences for the woman's health. Experts confirmed that the specialist did not comply with the methodology of the study. Misinterpretation of the MRI results became the basis for the appointment of surgery.[1]
