2020: Penalty for low-quality vacuum abortion

At the beginning of September, 2020 the Zavolzhye district court of Ulyanovsk fined local clinic "Medozon" for poor carried out vacuum abortion because of which the 31-year-old patient will not be able to have children any more.

In June, 2018 the woman addressed to clinic concerning termination of pregnancy by method of vacuum aspiration in the first trimester. During transaction she felt pains, shouted, but the doctor did not react to it in any way.

The doctor did not change tactics of conducting transaction, did not make the necessary decision on prevention of possible effects of influence that led to complications in time and after transaction, said in court's decision.

As it became clear later, the doctor injured a uterus. The woman got on the train and went to St. Petersburg, but on the road its status worsened, she was brought by ambulance crew in the Central clinical medical and sanitary part of V.A. Egorov where the damaged body had to be deleted. Further the claimant also needed additional reconstructive and recovery intestines operation.

On the basis of the above outputs, the court decided to collect Medozon LLC for benefit of the claimant compensation of moral harm of 1,000,000 rub, cost of services of inadequate quality of 7,800 rub, the lost earnings of 17,062 rub, expenses on payment for the services of the representative of 20,000 rub, losses of 6,109 rub, expenses on payment of the fare of 6,723 rub, a penalty of 300,000 rub.

At determination of the amount of compensation of moral harm the court considered the actual circumstances, in particular, that the rendered service led to loss of body owing to what the woman lost productive capability at 31-year age, the claimant was significantly limited in the normal life activity, transferred the emergency operational treatment, and after three and a half months – planned operational treatment — explained in court.[1]
