2011: Conflict with Tele2

In March, 2011 it became known that Neocorp Inc. owning telecommunication assets in the CIS countries submitted a claim against Tele2 to arbitration at the Stockholm chamber of commerce[1]. The claim is already registered, and trial dates are set for November, 2011, according to arbitration.

Neocorp requires that Tele2 performed the agreement on the redemption at it of the Orvell company owning 100% of Construction Management of Mobile Communication (CMMC) LLC for $38 million. The agreement was signed in the spring of 2007 in the run-up to the auctions for GSM frequencies at which Tele2 won licenses for 17 regions, having actually doubled the presence in Russia: now the company works in 37 regions. According to the representative of Neocorp, Tele2 asked it to help with planning of networks and preparation of platforms for their construction. Under the terms of tenders the quicker the operator promised to start network, the his chances of a victory therefore the Swedish company needed to get such support were higher. According to the agreement SMUPS undertook to submit reports on a configuration of network, priorities of its development and also to analyze the market in all competitive regions. And Tele2, in turn, had to redeem no later than March 31, 2008 Orvell from Neocorp. But Tele2 refused to pay, he says.

Even before completion of the transaction of Neocorp transferred Tele2 all documents to SMUPS, the representative of Neocorp claims. Then the group of the people who are the staff of the Russian representative office of Tele2, including the management, caused economic damage to SMUPS on 356.8 million rubles, said in the letter of the CEO of SMUPS Vyacheslav Chukanov which at the beginning of March, 2011 was sent addressed to the Minister of Telecom and Mass Communications Igor Shchegolev.

Chukanov refers to the audit report of YuVK Audit company of October 20, 2008 according to which SMUPS, in particular, carried out several transactions with "daughters" of Tele2 with a considerable loss for itself.

Upon causing damage the investigation department of the ATC of the Southern federal district of Moscow brought criminal case under the article "Fraud", said in Chukanov's letter. It was confirmed by a source in law enforcement agencies. But, according to him, now case is suspended because of impossibility to set guilty persons.

Against employees of Tele2 of any formal criminal cases it was not initiated, the chief legal adviser of Tele2 Bengtsson emphasized.
