2022: Introduction of the procedure for monitoring wine importers in Russia

As it became known at the end of October 2022, a monitoring procedure was introduced for one of the largest wine importers in Russia. We are talking about the company "Priorimpex."

The fact that the Moscow Arbitration Court recognized the application of Priorimpeks LLC for its own bankruptcy as justified and introduced a monitoring procedure against the company, Vedomosti writes with reference to the data on the court's website. It also says that the consideration of the claim on the merits will take place in February 2023.

Observation procedure introduced for Priorimpex

"Priorimpex," according to the Federal Customs Service, at the end of 2021, was the fourth largest importer of quiet and fortified wine to Russia. The company imported a total of 17.9 million liters of such drinks into the country.

Priorimpex has not applied for wine imports to Russia since mid-August 2022. The company's obligations to creditors exceed 160 million rubles. The bankruptcy procedure can help the company get rid of debts, according to lawyers interviewed by the publication.

In particular, Vladimir Khantimirov, managing partner of Asterisk Law Firm, notes that many facts in the case of this company indicate deliberate preparation for bankruptcy. He draws attention to the fact that the importer filed a lawsuit to declare himself insolvent even before the moratorium expired in October, which may indicate a rush. According to him, usually creditors initiate bankruptcies, and not the debtors themselves, because in this case they can appoint their manager, and not rely on the choice of a judge.

What assets by the end of October 2022 belong to Priorimpex and whether they will be enough to pay off debts to creditors is not known for sure. According to SPARK-Interfax, he does not own real estate or vehicles. But it indicates that he pledged alcohol products in circulation in Metallinvestbank in the amount of 25 million rubles.[1]
