2014: Arrest of founders and the CEO in the matter of FCS

On October 31, 2014 the message that the Main Investigation Department of ICR across Moscow brought concerning the lieutenant general Alexey Shashayev criminal case according to Part 3 of Article 285 of UK (the abuse of office which entailed heavy effects) was published in the Kommersant newspaper.

For November 5, 2014 it together with defenders is caused in GSU ICR for brining a charge. On the general incriminated to crime threatens up to ten years of imprisonment. Almost all other persons involved in this high-profile case at first were defined in the pre-trial detention center.

In turn, protection does not exclude that ICR, having informed the general on investigative actions, perhaps in advance, tries to put pressure upon it, having provoked to escape, but Alexey Shashayev "is not going to disappear as it intends to prove the innocence".

According to the investigators, the lieutenant general Shashayev, directing the head department of information technologies (HDIT) of FCS, and his subordinate — deputy chief of department of planning of equipment by means of informatization Elena Soboleva abused powers, having entered the informal relations with SBL-Technologies LLC — the old partner of customs service. Aiming to earn from contracts with the company releasing the software for the system of Oracle used in FCS, the staff of GUIT prepared conditions of tender of 2012 in such a way that could win it only against SBL-Technologies. At the same time the cost of the contract which it was announced on the portal of state services zakupki.gov.ru was overestimated, according to the investigators, to 332 million rubles businessmen could "roll away" it then to organizers in advance stipulated 15% of the means paid to them.

The ICR determined the actual cost of the contract which as a result was signed about SBL-Technologies in 206 million rubles. And damage caused by actions of staff of FCS to the state, according to the investigators, was 125 million rubles.

At the same time the organizer of criminal group the investigation believes not customs officers, but the entrepreneur Igor Beregovsky who is the cofounder SBL-Technologies. That, according to the investigators, involved in case of other cofounder of Ltd company — Stanislava Sorokina, and already they together persuaded to participate in tender for rollbacks of the CEO SBL-Technologies Vyacheslav Lysakov.

According to Kommersant, investigation of a high-profile case began after surrender in investigating bodies fall of 2013 of Vyacheslav Lysakov. Kommersant, having agreed to cooperate with the investigation, under control of field investigators cashed 76 million rubles which it had to transfer by parts Stanislava Sorokina, and that, in turn, to Igor Beregovsky. The last, calculated the investigation, will bring rollback to the people in FCS.

However special operation failed. Stanislav Sorokin, having twice got notes which numbers were in advance rewritten, did not transfer them on a chain, and put in the safety-deposit box. On the third time when Vyacheslav Lysakov managed to meet on December 12, 2013 at last both founders SBL-Technologies at Bakinsky Boulevard restaurant, all three were delayed by the staff of FSB. At the same time they issued receiving by founders of Ltd company of 46 million rubles However, to cooperate with the investigation and Igor Beregovsky refused to bear money under control of field investigators in FCS, having reported that he does not locate any corruption communications at customs. As a result all three were accused according to Part 4 of Article 159 of UK (large scale fraud). Vyacheslav Lysakov bailed, and his accomplices Sorokin and Beregovsky were arrested by Presnensky district court.

After that investigators and field investigators were engaged in the employee of FCS Sable, preparing tender. At first, according to protection, it suggested to cooperate too, but she refused. And in February, 2014, without having detected the woman in Moscow, GSU ICR put her on the wanted list. However, it turned out that it does not disappear, and it is treated in departmental sanatorium of FCS in Caucasus Mineralnye Vody region. There, after the woman announced the location to the investigator the telegram, it was delayed, but the Kislovodsk city court refused to ICR its placement to the pre-trial detention center, having limited to house arrest. Only in May, 2014 after long trials Presnensky district court defined it in the camera, and at a meeting the accused and its protection declared pressure put upon them with the purpose to achieve indications on the high-ranking staff of FCS.

On October 28, 2014, when brought to Elena Soboleva charge in the new edition, having added to fraud of Part 3 of Article 286 of UK (abuse of office with causing heavy effects), she gave evidence to the investigation unrolled. In them, in particular, it was reported that the employee of FCS does not admit the guilt, and with entrepreneurs and the more so with the general Shashayev she did not enter collusion. According to the defendant, she did not disclose the service information on tender preparation to representatives SBL-Technologies and did not enter so-called tabs to auction conditions thanks to which this company won.

Elena Soboleva explained need of carrying out the tender with "numerous failures and errors" in work of specialized programs which are used by FCS. Besides, Elena Soboleva drew the attention of the investigation to "a charge disagreement" that the 15 percent amount of rollback which participants of criminal group allegedly expected to receive obviously does not correspond to unreasonable overestimate of cost of the government contract on 125 million rubles as consider in GSU ICR.

In turn, protection of the lieutenant general Shashayev, having studied the evidence, addressed to the State Office of Public Prosecutor, having pointed out illegality and groundlessness of criminal proceedings. As Kommersant knew, lawyers believe that from the resolution GSU ICR in general it is not clear what criminal acts their client could commit. According to them, the general Shashayev personally was not engaged in development of the tender documentation, did not enter any data in it and did not exclude from it, being one of eight members of the commission of FCS on placement of state orders. And all other members of the commission were not the general's subordinates, and he could not influence the solution of the deputy head of FCS entering her at all in any way.

Lawyers called the link of the investigation to the "tabs" in the conditions of tender which allowed to win SBL-Technologies it unacceptable as the auction was held on the open area, each their participant had an information access and could perform requirements of FCS. Results of biddings were disputed by nobody, the contract was completely executed in January, 2014. SBL-Technologies LLC exacted through arbitration from FCS more than 30 million rubles — the money which is not paid to the company for the last stage of works within the government contract.

"The adoptions of the investigation about commission by the general Shashayev of crimes are based on testimonies of defendants which at the same time are participants of this crime and are depending on the investigation therefore it is impossible to recognize them reliable in any way", says the appeal of lawyers^[1].

Let's note, as Stanislav Sorokin decided to cooperate with the investigation then he was translated from the pre-trial detention center under house arrest.

Defenders ask supervising department to study the criminal case file and to repeal the resolution on its excitation.
