2014: On the verge of bankruptcy

In July, 2014 city authorities of Moscow terminated four contracts with the large construction contractor of NPO Kosmos: on reconstruction of Dmitrovskoye Highway, Bolshaya Akademicheskaya Street, Leningradskoye Highway, on construction of the parking over Alabyano-Baltic tunnel. Kosmos performed works on them partially and remained owes the city more than 3 billion rubles. Other large contracts with Kosmos — on construction of a part of Alabyano-Baltic tunnel and reconstruction "Helicon opera" — are not terminated yet, losses on them are counted. The city did not join yet tens of private companies which want to recover debts at Kosmos through court and require to declare him bankrupt. The department of construction reported that the Moscow authorities will carry out settlement with the contractor.

The Moscow Department of Construction and Space terminated all contracts "by agreement of the parties". The contract for reconstruction of Dmitrovskoye Highway which cost was 4.8 billion rubles was terminated on July 15, 2014. The contractor had to build the traffic intersection on intersection with 3rd Nizhnelikhoborsky Drive. According to documentation placed on the portal of state procurements, the city paid all amount, but works were performed only for 3.3 billion rubles. Thus, the debt of Space to the city was 1.5 billion rubles.

On July 15, 2014 it was also terminated the contract for reconstruction of Bolshaya Akademicheskaya Street — its cost was 6.2 billion rubles. The city paid 5 billion rubles, and works were performed for 3.7 billion rubles. The debt to the city made 1.3 billion rubles.

On June 23, 2014 the contract for reconstruction of Leningradskoye Highway from the Falcon metro station to MKAD was terminated. "Space" received on it all amount — 1.8 billion rubles. Works were performed for 1.6 billion rubles. The debt made 200 million rubles.

On June 23, 2014 it was also terminated the contract for arrangement of parking spaces "in technical space over overlapping of the Baltic tunnel". The price of the contract was 421 million rubles. The city paid 165 million rubles. "Space" performed works for 79 million rubles. Debt — 86 million rubles.

Not terminated there are two construction contracts of Alabyano-Baltic tunnel, their cost of 14.6 billion rubles. and 5 billion rubles. Within contracts the contractor should construct an outcome Leningrad both Volokolamsk Highway at the Falcon metro station and the overpass on intersection of streets Baltic and Big Academic with the Riga direction of the Moscow Railway.

Earlier the head of a capital building complex Marat Khusnullin said that Space is not capable to fulfill the obligations for Alabyano-Baltic tunnel, these obligations will be undertaken by the Mosinzhproekt company belonging to the city. Acting so far there is also a contract worth 671 million rubles for reconstruction "Helicon opera".

On a request for whether the city will take legal action to recover a debt from Kosmos, in the press service of department of construction answered: "Now there is collecting and the analysis of documents under all existing and terminated contracts with NPO Kosmos. Settlement will be carried out".

Several tens of the companies submitted to Arbitration court of Moscow claims to Space with the requirement to return debt:

  • Glavstroygroup requires a debt in 400 million rubles,
  • Lizingstroymash — 6.1 million rubles,
  • Spetspromstroy — 1.3 million rubles.

Since January, 2014 the court considers the case of bankruptcy of Space. The next meeting is appointed to August 13, 2014. Applicants on case — Stroikompleks 3 LLC, JSC Central Research and Development Institute of Transport Construction, Dorstroy-AB LLC. In February, 2014 the court permitted to go into action as one more applicant of Moskomstroy-nedvizhimost LLC.

At a meeting with public advisers of the Northwestern Federal District which took place in March, 2014 Marat Khusnullin told that the Moscow authorities are indirectly involved in a situation which resulted Space in bankruptcy.

— When began to build (Alabyano-Baltic tunnel. — Izvestia), really got on the underground river — the official told. — Got to the most difficult hydrogeological conditions, the project had to be changed on the course … but it was succeeded to start one tunnel at the end of last year. The second tunnel was wanted to be started by the end of the year — the second problem: the contractor went bankrupt. Including, by the way, because of this tunnel. This huge number of new, unforeseen works. Because it is necessary to concrete urgently, to urgently perform works. Including indirectly and we have to it relation too that at the contractor such financial situation[1].

The chairman of Gradient Alpha audit and consulting group Pavel Gagarin noted that if the city files a lawsuit against the contractor, other contractors can regard it as weakness.

— Thereby the city undersigns for a lack of administrative resources to resolve it an issue — the expert told. — It will show that with it it is possible to act this way.

According to the head of Mosproject-5, the former head of Genplan Institute of Moscow of Sergey Tkachenko, theoretically settlement of the city and the builder is possible. In the analysis of yet not terminated contracts it can turn out that the company somewhere performed more works, than it was paid.
