The Cisco company was accused of pressure upon competitors and participation in arrest of the CEO of independent supplier company of services. Cisco claims - it is not we. Customers show discontent with Cisco service. The independent companies are silent so far.
The independent supplier of service and support of network equipment of Multiven filed a lawsuit against Cisco in 2008, claiming that the company monopolized the market of its software. Cisco put forward the counter action, stating that Alfred-Adeka cracked Cisco computers and stole the software protected by copyright.
In May, 2010 Alfred-Adeka was arrested in Vancouver (Canada). According to the warrant for the arrest - on 97 counts in intended access to the protected computer system, without authorization, for the purpose of obtaining commercial benefit. He can be sentenced to 10 years of imprisonment and $250 thousand a penalty. The arrest became known only this week after the press of Vancouver reported about it.
After almost monthly detention he was released on bail, but cannot leave Canada since then, the Sound board Yusuf (Deka Yussuf), the executive vice president of Multiven for marketing and public relations told.
Yusuf reported that for the last 10 months business came to a standstill because the office of the federal prosecutor of the USA could not produce the evidence necessary for Alfred-Adeka's extradition.
Alfred-Adeka's lawyers consider that the American officials, perhaps, misled the Canadian authorities about need of arrest and issue of their client, and now in Vancouver listenings are begun to investigate such opportunity. "We consider it the answer of Cisco to the antimonopoly claim which to it was made by Multiven", - told Yusuf. – We are sure that Cisco organized this arrest and legal procedure against Adeki to force Multiven to settlement of the claim". Before this arrest case of Multiven had to appear before jury, she added.
Cisco stated the following: "The claim of Multiven is absurd. This case - a question of the relations between public authorities of the USA and Canada. We know that the warrant for the arrest issued by the judge of the USA on the basis of criminal proceedings according to the report of the special secret service agent was the basis for the request for extradition".
Alfred-Adeka was arrested unexpectedly, testifying under oath lawyers of Cisco in hotel of Vancouver.
The office Multiven claims that Cisco forces owners of the equipment to buy contracts of SMARTnet service, for receiving software updates and error correction in it. It limits services of the independent companies, such as Multiven.
Multiven repeated what was expressed by some clients expostulating Cisco on the fact that it should correct the errors free of charge as it is done by Apple and Microsoft. Some customers speak, the problem becomes complicated when using of the second-hand and repaired equipment.
Contracts of service of Cisco cannot be transferred from one user to another so second-hand buyers of the equipment should send it for testing to Cisco before they are able to purchase the new contract. And this action can cost quite much. In addition, the probability not to receive the contract SMARTnet for the equipment which is laid off is high.
As Brad Reese, the research manager of BradReese.Com (the company implements and services the repaired equipment of data networks) reported, there is a considerable market of the "secondary" equipment Cisco existing at the expense of buyers who are not able to afford the new equipment and those who need models of routers or switches which new models are unavailable. By its estimates, the volume of secondary market of network equipment about $2 billion, at the same time 90% of sales become at the expense of the equipment Cisco.
