2020: Judicial proceedings because of transfer of secrets to the competitor
At the end of November, 2020 Siemens Healthineers filed a lawsuit against one of the former top managers as that stole the trade secret connected with development of warm catheters. The company claims that her former vice president Anthony Medigo violated the confidentiality agreement when passed into NuVera Medical, the competitor of Siemens Healthineers.
On the data which are available for us, Medigo's work in NuVera means that it will assist the new company in connection with development of catheters which directly will compete with products of Siemens, in particular, catheters of AcuNav V and AcuNav Volume ICE, said in the statement of Siemens. |
Catheters of AcuNav V and AcuNav Volume ICE are used for visualization of inner patterns of heart at procedures of replacement of the valve. The Siemens company states that these products represent new generation of catheters, and the expected profit on their sale by 2030 will make $800 million a year.
It is said in the statement that Medigo employed by Siemens company in 2016 by 2019 became the global vice president for production of warm catheters and played an important role in development and commercialization of a new product line. However messages about ghost effects led to a time withdrawal of catheters of AcuNav Volume from the market in March, 2020. In reply the company cut down the staff, including Medigo to whom the severance pay in the amount of $405,000 was paid, and confirmed the confidentiality agreement signed with it.
In September, 2020 Medigo was employed as the commercial director of NuVera which registers own warm catheter for release on the market. Siemens made to Medigo the claim for eight points, including contract breach, unjust enrichment, misappropriation of a trade secret and violation of fiducial obligations. The company also requires to indemnify pecuniary damage and to prohibit Medigo to work with NuVera at least till July, 2021.[1]
