Arrest

Former head of Plastic Logic Boris Galkin was arrested in the case of embezzlement of funds allocated by Rusnano Corporation. This became known on August 28, 2024^[1] was^[2]In fact, the detention took place in June, as it later became known from court orders published in the database of courts of general jurisdiction in Moscow. A court in Moscow decided to place the accused in a pre-trial detention center.

The criminal case was initiated on April 21, 2023 under Part 4 of Article 160 of the Criminal Code of Russia, which provides for responsibility for embezzlement on an especially large scale. Rusnano was recognized as the injured party in this case. During the investigation, it was found that the funds allocated to Rusnano were not used for their intended purpose, and the Plastic Logic company was unable to restore its solvency, which caused the initiation of bankruptcy proceedings.

Plastic Logjik CJSC was established in 2010 as part of a joint project between Rusnano and British Plastic Logic. In Zelenograd, it was planned to build a plant for the production of flexible displays with a capacity of 100 thousand units per year and create an R&D center in the country. In 2011, Chubais showed Vladimir Putin, who was then prime minister, a Plastic Logic 100 electronic tablet for schoolchildren. It was expected that the devices would go on sale in November 2011, but the project was never implemented, and attempts to resuscitate it later did not lead to success.

In 2014, the Accounts Chamber conducted an audit of Plastic Logic. Auditors then indicated that Rusnano acquired for 7.1 billion rubles. 44% of the shares of the Irish Plastic Logic Holding, the funds were almost immediately transferred to Plastic Logic Luxemburg. In parallel, Plastic Logzhik CJSC was created in Russia. The Russian company, under the guarantee of Rusnano, issued loans from banks for 5.7 billion rubles. and issued them as a loan to Plastic Logic Luxemburg at low interest until 2020. With this money, Plastic Logic Luxemburg bought the shares of its lender, the Russian Plastic Lodge. As a result, more than 5 billion rubles were in the accounts of Plastic Logic Luxemburg, and only 620 million rubles remained in the accounts of Plastic Lodge by 2013.

Boris Galkin was the general director of Plastic Logic in 2012-2016, according to the database of legal entities Kontur.Fokus. And CJSC (later JSC) "Plastic Logic" lasted until 2019. In 2019, the company had a successor - Plastic Logic LLC was formed.

FSB report on criminal case

On October 25, 2024 on the official site of Federal Security Service of the Russian Federation (FSB) the message about criminal case in which Boris Galkin^[3] is involved was published^[4]. It follows from it that the criminal case is about embezzlement of more than 13 billion rubles. "Previous top management" "Rusnano" in order to implement the innovative project "Organization of the production of displays and other devices using the technology of plastic electronics of the new generation" transferred "Plastic Logic" funds received from the budget of the Russian Federation, but as a result, innovative production was not created, and the allocated funds were withdrawn for foreign jurisdictions, the report said.

According to the FSB, "since 2020, B.Yu. Galkin has been hiding from law enforcement agencies abroad, in 2024, at the entrance to the territory of the Russian Federation, he was detained by security officers."

A case of particular complexity: Boris Galkin is not allowed under house arrest

As TAdviser discovered in November 2024, the former general director of Plastic Logic, Boris Galkin, detained in June, repeatedly tried to mitigate the preventive measure chosen and subsequently extended by the court in the form of detention - replacing her with house arrest. So far, this has proved inconclusive.

The database of courts of general jurisdiction in Moscow contains three appeals to the Moscow City Court on this matter. The last time the term of detention of Boris Galkin was extended until December 21, 2024.

In the last appeal decision published in the same database, the Moscow City Court agreed with the arguments of the first instance, which she cited when extending the term of detention in the pre-trial detention center to Boris Galkin. Among them was that he was accused of committing a serious crime as part of an organized criminal group, not all of whose members were identified and detained, using his official position, and also had a residence permit of another foreign state. As can be seen from the materials presented, a particular complexity is seen in the criminal case, based on the nature of the imputed act, the volume of investigative and procedural actions that were carried out and must be carried out in the criminal case to complete the investigation, "the Moscow City Court said in its latest appeal decision[5].

At the same time, lawyers do not agree with the conclusion of the court of first instance that the production of a preliminary investigation in a criminal case is especially difficult. The defense does not agree, including with the fact that the accused can hide from court and investigation, which is one of the reasons - his foreign passport was seized by the preliminary investigation authorities.

Earlier, challenging the preventive measure, among the arguments of Boris Galkin's defense was also that the accusation "lacks a description of any criminal actions of Galkin B.Yu.," and that he "could not make decisions on his own." What decisions are in question is not specified in the document published in the database of courts of general jurisdiction of Moscow. Also, one of the arguments of the lawyers is "the crime is not properly described, and the material does not provide evidence of embezzlement"^[6]
