2022: Receiving a suspended sentence for bribes to the ex-head of the Altai Ministry of Health

At the end of August 2022, a court in Gorno-Altaysk (Altai Republic) sentenced entrepreneurs from Novosibirsk Galina Drobysheva and Mikhail Alekseev, who were accused of bribing officials of the Ministry of Health of the Altai Republic. Both were given a suspended sentence: a man - 4 years and 6 months, a woman - 4 years. They will also pay a fine totaling 22 million rubles, the press service of the Investigative Committee for the Altai Republic reported.

The investigation and the court established that in the period from November 2020 to January 2021, a 28-year-old citizen of the Republic of Kazakhstan, living in the Novosibirsk region, and a 32-year-old resident of Novosibirsk, who actually led two commercial organizations, acting by a group of persons by prior conspiracy, while in Gorno-Altaysk, they personally handed over to the Minister of Health of the Altai Republic and his assistant in three tranches a bribe in the form of money on an especially large scale in the amount of 13 million rubles for concluding direct state contracts with legal entities controlled by them for the supply of personal protective equipment for the needs of the republic's health care system, ensuring their subsequent unhindered adoption and timely payment.

According to the investigation, when committing a crime, Mikhail Alekseev developed a complex scheme of criminal activity, including by registering controlled organizations with dummy individuals, as well as misleading them in order to conceal traces of the crime and divert suspicions from law enforcement agencies.

The defendants in the case were found guilty of committing crimes under paragraph "c" of Part 5 of Art. 291 of the Criminal Code of the Russian Federation (giving a bribe to an official personally, committed by a group of persons by prior conspiracy, on an especially large scale).[1]

2023: Replacement of probation with real

Entrepreneurs Galina Drobysheva and Mikhail Alekseev, who paid bribes to officials of the Altai Ministry of Health, the suspended sentence was replaced with a real one. The corresponding decision at the end of November 2023 was made by the collegium of the Supreme Court of the Altai Republic.

The investigation and the court previously established that Mikhail Alekseev and Galina Drobysheva, being the actual leaders of two companies - LLC Prostor and Protek, legally registered as dummies - personally handed bribes totaling 13 million rubles to the then Minister of Health of the Republic Sergei Kovalenko and his assistant Rustam Tuyunchekov. For this money, officials provided firms with the conclusion of direct state contracts for the supply of personal protective equipment for the needs of regional medical institutions, subsequent acceptance of goods and payment.

Initially, businessmen were sentenced to suspended sentences under paragraph "c" of Part 5 of Art. 291 of the Criminal Code of the Russian Federation (giving a bribe to an official personally, committed by a group of persons by prior conspiracy, on an especially large scale). The man received 4.5 years, and the woman - four years. Also, each of them was assigned a probationary period of five years. In addition, they were obliged to pay fines in the amount of 9 million and 13 million rubles, respectively. At the same time, the convicts were deprived of the right to engage in entrepreneurial activities in the field of circulation of medical goods and products for three years.

However, this verdict was appealed. On October 31, 2023, the judicial board for criminal cases of the Supreme Court of the Altai Republic considered the appeal and concluded that the judicial act was subject to change. Thus, from the circumstances mitigating the guilt, a reference to the confession of a confession as a mitigating circumstance was excluded. In addition, an indication of a suspended sentence was removed from the sentence, replacing it with real imprisonment. At the end of October 2023, the verdict entered into legal force.[2]
