2023: Charge of procurement of counterfeit drugs worth 10.3 million rubles
The Prosecutor's Office of the Republic of Ingushetia approved the indictment in a criminal case against the chief physician of the Republican Oncological Dispensary. He is accused of committing a crime under paragraph "c" of Part 3 of Art. 286 of the Criminal Code of the Russian Federation (abuse of office, which entailed a significant violation of the rights and legitimate interests of the organization, the interests of society and the state protected by law, with serious consequences). This was announced on February 14, 2023 by the press service of the Prosecutor General's Office of the Russian Federation, without specifying the name of the accused.
According to the source of the publication "RBC Kavkaz" in the power structures, the defendant in the criminal case is Moussa Gezgiev. It was he who by mid-February 2023 on the website of the Republican Oncological Dispensary in Ingushetia was indicated as the current head physician of the institution by February 17, 2023, as the journalist Zdrav.Expert was convinced of.
According to the investigation, in 2021, the chief physician of the Republican Oncological Dispensary, exceeding his official powers, accepted and paid in cash the Territorial Compulsory Health Insurance Fund for medicinal oncological drugs that do not meet the terms of contracts, without documents confirming their quality and legality of origin. In total, more than 10.3 million rubles were transferred to the supplier's accounts.
We are talking about the company "Business South," which is suspected of re-selling previously sold drugs for the treatment of cancer, which have already been delivered to medical institutions in other regions, reported "Pharmaceutical Bulletin." During the prosecutor's check, it turned out that in order to form the value of the contract, the oncology dispensary turned to three suppliers, including Business Yug, Oksana and Medzdrav. Price offers differed from each other by 100 rubles, later it was possible to confirm the affiliation of these companies with the help of auction documentation.[1]
2026: New sentence - 4 years 6 months in prison for buying counterfeit drugs for cancer patients
The Supreme Court of Ingushetia toughened the punishment of the former chief doctor of the republican oncological dispensary, Moussa Gezgiev, who was found guilty of purchasing counterfeit medicines for cancer patients. The court replaced the suspended sentence for serving in a general regime colony for 4 years 6 months. This was reported in the press service of the court on February 25, 2026.
According to the materials of the case, in 2020 Gezgiev had intent to commit actions that went beyond his powers. In 2021, an oncological dispensary represented by the head physician concluded government contracts with Business Yug for the supply of anticancer drugs. In the absence of legal grounds for accepting the goods, Gezgiev signed consignment notes and invoices, confirming the proper quality and compliance with the contracts, although the supplied medicines were counterfeit and in circulation in violation of the law.
Based on the applications signed by the defendant for cash consumption from the personal account of the dispensary, the funds of the territorial compulsory health insurance fund (TFCMI) of the republic in the amount of more than 10.3 million rubles allocated for the provision of medical care under compulsory medical insurance were transferred to the supplier's account.
Gezgiev was charged under paragraph "c" of Part 3 of Art. 286 of the Criminal Code of the Russian Federation (abuse of office with causing serious consequences). In court, he pleaded not guilty.
The Magassky District Court initially sentenced the 38-year-old defendant to 4 years 6 months of suspended imprisonment with a probationary period of 3 years and deprivation of the right to hold certain positions for 2 years. The civil claim of the representative of the dispensary was satisfied: 10.3 million rubles were recovered from Gezgiev against compensation for damage.
The prosecutor appealed the verdict, the defender appealed. The Supreme Court of Ingushetia replaced the suspended sentence with a real one. The defendant was taken into custody in the courtroom. In the rest of the sentence was upheld. The court decision entered into legal force.[2]
