2024: Seizure of property worth 22.6 billion rubles

On August 9, 2024, the City Arbitration Court Moscow upheld an earlier decision to seize the property of the former chairman of the board of directors of JSC Russtroybank Nikolai Ivashchuk in the amount of about 22.6 billion rubles. Interim measures were taken as part of a dispute over bringing Ivaschuk to subsidiary liability.

As part of the case, the chairman of the board of Russtroybank Andrei Strukov, the chairman of the board of directors Dmitry Ivashchuk (son of Nikolai Ivashchuk) and the beneficiary Olga Sorokina were also brought to subsidiary responsibility. The potential amount of liability is more than 22.6 billion rubles. The final amount will be determined upon completion of settlements with creditors.

According to the RF IC, in the period from 2012 to 2015, the chairman of the board and beneficiary of Russtroybank Strukov, together with unidentified persons, stole the property of this organization in the amount of at least 400 million rubles. The Central Bank of the Russian Federation revoked Russtroybank's license on December 18, 2015 due to loss of liquidity and non-fulfillment of obligations to creditors. In addition, the regulator found that the credit institution was involved in conducting dubious transit operations in large volumes.

The arrest on the property of Nikolai Ivashchuk (with the exception of funds in the amount of the subsistence minimum of a citizen and persons dependent on him) was imposed on April 4, 2024 by the Moscow Arbitration Court at the request of the state corporation Deposit Insurance Agency (DIA). On July 17, 2024, this decision was supported by the Ninth Arbitration Court of Appeal.

Taking interim measures if N. Ivashchuk is brought to civil liability will increase the likelihood of actual receipt of funds in favor of the bank's creditors, the DIA website says.[1]
