Biography

2023: Sentence - 6.5 years in prison for major fraud

The Dorogomilovsky District Court of Moscow sentenced the former general director of Farmservice Konstantin Belyaev to 6.5 years in prison on charges of large-scale fraud and attempted crime (part 3 of article 30 and part 4 of article 159 of the Criminal Code of the Russian Federation). This became known on October 1, 2023.

According to Kommersant, the criminal case, of which Belyaev became a defendant, was initiated by the capital's Main Investigative Directorate of the Investigative Committee of the Russian Federation in 2021 against the former founder and president of the audit company RSM-Rus Elena Loss and the former general director of Probiopharm Liya Muradova (both were arrested in absentia and are on the international wanted list). The reason for the start of the investigation was the appeal to the law enforcement agencies of Elena Tereshkova and Dmitry Savelyev, who were subsequently recognized as victims in the case. In July 2021, Konstantin Belyaev joined the ranks of the defendants in the case. He was charged; by decision of the Presnensky court of Moscow, he was arrested (later, his stay in the pre-trial detention center was replaced with house arrest).

According to the investigation, the organizer of both crimes in question in the criminal case - an attempt to seize Pharmservice and fraud in the supply of equipment for filling capsules with probiotics - was auditor Elena Loss, and the performers were Belyaev and Muradova.

In 2018, the manufacturer of probiotics, Partner JSC, was declared bankrupt, and in the spring of 2019, Pharmservice became the copyright holder of 30 trademarks owned by Partner, including Bifidok. The production lines and real estate of JSC, put up for auction, were acquired by Probiopharm, which belonged to Liya Muradova by 30%, Elena Tereshkova by the same amount and Dmitry Savelyev by 40%.

In mid-March 2020, Loss took over as an adviser to the general director of Probiopharm, and from February 1, 2021, to a similar position at Pharmservice. The auditor took control of the company, as well as the associated Avan LLC. At the same time, according to investigators, Loss developed a plan to seize 100% of the shares in Pharmservice. In March 2021, she, Belyaev and Muradova received a fictitious act of assessing the assets of this pharmaceutical company for 470 thousand rubles. However, in the case file, assets are estimated at 313 million rubles. Then Loss received the consent of Leah Muradova to sell Pharmservice shares. Thus, Tereshkova and Savelyev learned that their business already has a new owner and they have nothing to do with it.[1]
