2026: Recovery of 273 thousand rubles and monthly payments of 9 thousand rubles in favor of the son of a patient who died from unnecessary surgery

In February 2026, the Leninsky District Court of Nizhny Tagil satisfied the claim for the recovery from the surgeon Mikhail Shalagin of monthly payments in the amount of 9 thousand rubles in favor of the minor son of the patient who died after a medical error. Earlier, the medic was found guilty of causing death by negligence.

According to the press service of the courts of the Sverdlovsk region, at the end of 2022 the woman was admitted to the Demidov city hospital. The patient required stenting of the bile duct - a procedure for installing a special frame to expand the narrowed area, but the surgeon performed a different operation. Complications that developed after the intervention led to death.

In October 2025, Mikhail Shalagin was found guilty under Part 2 of Art. 109 of the Criminal Code of the Russian Federation (causing death by negligence due to improper performance of professional duties). The court decision confirmed a direct causal relationship between the defects in medical care and the death of the patient. Earlier, compensation for moral damage in the amount of 5 million rubles was requested from a medical institution in favor of the family of the deceased.

According to a new court decision, a one-time compensation was collected from surgeon Shalagin for the period from 2023 to 2025 in the amount of about 273 thousand rubles. The calculation was made based on the size of the average monthly earnings by profession of the deceased in the region for 2021, which amounted to approximately 26.2 thousand rubles.

From January 1, 2026, the doctor is obliged to pay monthly monetary compensation to the son of the deceased patient. The initial amount of 9 thousand rubles is subject to annual indexation. Shalagin will have to make payments until the child reaches adulthood in 2038. If the son of the deceased woman enters full-time education, the obligations will last until graduation, but not later than he reaches the age of 23 years.[1][2]
