2023: Sales halt over technology theft charge
On December 18, 2023, Apple announced the termination of sales of the Watch Series 9 and Watch Ultra 2 smartwatches in the United States due to patent proceedings. The Cupertino-based company is accused of illegally using technology related to measuring blood oxygen saturation (SpO2) levels.
We are talking about a possible violation of patents by Masimo, which develops medical solutions. It is alleged that Apple hired former Masimo employees and then implemented a proprietary pulse oximetry system in its wearables. In October 2023, the US International Trade Commission (ITC) concluded that Apple had indeed violated Masimo's patent for technology to measure blood oxygen levels.
Masimo CEO Joe Kiani says Apple deliberately used patented developments. According to him, Masimo is open for negotiations on this issue, but the opponent is not trying to resolve the conflict peacefully. In turn, Apple says Masimo's allegations are aimed at "clearing the way" for its own smartwatches. At the same time, Apple filed a counterclaim against Masimo with allegations of patent infringement.
In accordance with the decision made by Apple, the Watch Series 9 and Watch Ultra 2 will become unavailable for order in the American market through the company's website from December 21, 2023. In retail stores, sales will stop on December 24, 2023. However, the ban does not apply to other models of the gadget that do not contain an oxygen sensor in the blood, such as the cheaper Apple Watch SE. In addition, the company will continue to offer previous generations of smartwatches. Apple also says it considers ITC's decision to be flawed.[1]
