Getting the Registry Started
On September 1, 2023, a federal register of producers of beer and beer drinks, cider, poiret, mead was launched in Russia. The initiative will strengthen state control over the activities of such companies.
The register of beer producers includes the organizations themselves, as well as all their separate divisions. It contains the name of the manufacturer, its address, TIN, list of products and other information. They will be posted on the Rosalkogolregulirovanie website in the public domain.
As the director of the Pervorechensky brewery Andrei Dmitriyev explains, the registration procedure itself did not begin to operate on September 1, 2023. Brewers will be given about a year to prepare equipment and relevant documentation. The main change will be the introduction of meters. Now they will be installed at breweries that produce 100 dal per year. Previously, this was necessary only for companies whose production volume was 300 decaliters per year.
Those enterprises that were previously small will immediately legally become large. Now the legislator is trying to settle everything, but the problem is that, solving one problem, he creates a new one. As Vyacheslav Mamontov, executive director of the Association of Beer, Malt and Beverage Producers (APP), said in an interview with Interfax in July 2023, the register will allow the regulator to more influence the state of the market in terms of control functions. In particular, the law allows, in violation of requirements, to suspend or prohibit the production of products. Prior to that, Rosalkogoltabak did not have such an opportunity.
According to him, the most important innovation in the law on the register is the reduction of the threshold, which allows not to install automatic meters of the volume of products, from 300 thousand decaliters to 100 thousand decaliters per year. But this is not enough, Mamontov believes.
All manufacturers should have equal responsibilities in the market, there should be no exceptions either in terms of volume or in terms of enterprise size. Meters should be at all enterprises, and when the enterprise is included in the register, unscheduled inspections should be provided to fix the main technological equipment it has, he emphasized.[1] |
Adoption of the law on the creation of the registry
On March 21, 2023, the State Duma adopted a law on the creation of a single register of producers of brewing products, cider, poire and mead. Rosalkogolregulirovanie has been appointed its operator.
The document obliges these manufacturers to register in the register, which will be launched on September 1, 2023. When included in this list, an unscheduled inspection of the organization is provided to establish that it has the main technological equipment.
As follows from the explanatory materials to the document referred to by Interfax, the permissible threshold for the maximum production capacity of the main technological equipment for the production of brewing products is reduced from the existing 300 thousand to 100 thousand decaliters per year, in which manufacturers do not have the obligation to equip the main technological equipment with automatic measuring and accounting tools for the volume of finished products.
The initiator of the adoption of the law, a deputy from United Russia, Ildar Gilmutdinov, previously drew attention to the fact that organizations connected to the EGAIS system appear on the brewing market, but in fact do not produce products. According to him, these are "one-day," through which brewing products are put into circulation, produced by "unknown manufacturers at unknown production addresses."
The law enshrines a list of information on the basis of which the EGAIS will take into account the volume of production of brewing products subject to mandatory labeling.
In addition, according to the document adopted by the State Duma, from January 15, 2024, it is envisaged to cancel the declaration of the volume of retail sales of brewing products - retail sales will be recorded in EGAIS on the basis of data from the state information system for labeling goods, where information will be sent when retail sales of brewing products.[2]
