Elizabethan hospital sued millions from IT system provider for poor-quality digitalization

In December 2021, the Arbitration Court of St. Petersburg and the Leningrad Region ruled to recover 7 million rubles from Brainsystems in favor of the Elizabethan Hospital. The medical institution filed a lawsuit accusing the contractor of low-quality digitalization.

According to Kommersant, citing the press service of the Elizabethan Hospital, the conflict between it and Brainsystems began back in 2019. The work itself, which became the subject of the dispute, was carried out by the company in 2018.

The contractor performed development work, the result of which was a prototype of the system, put into pilot operation at the customer's technological site and containing a number of shortcomings that prevent its use for its functional purpose, the expert opinion attached to the case indicates.

Because of this, the medical institution was forced to urgently introduce a new system. It is clarified that at first programmers with violations installed the MedSphere system. The hospital had to quickly switch to the QMS MIS, which, as noted, is successfully used by December 2021.

The hospital filed a lawsuit with the Arbitration Court of St. Petersburg and the Leningrad Region for compensation for damage. The court eventually sided with the medical institution and ordered the contractor to pay monetary compensation to the hospital.

The arbitration process lasted almost two years. I am glad that the court made a fair decision to recover more than 7 million rubles in favor of the hospital, "commented the head physician Sergei Petrov.

Earlier, the Investigative Committee opened a criminal case of fraud against the leadership of the Elizabethan Hospital in St. Petersburg. According to the investigation, the institution installed a blank program for 18 million rubles, instead of using the old Brainsystems software[1]
