Putin unexpectedly rejected the law on creation of a system of accounting of school students

As the customer of the Uniform federal interdepartmental system of accounting of the contingent of students according to the main educational programs and additional general education programs (a federal segment of the IC "Contingent") the Ministry of Telecom and Mass Communications of the Russian Federation for the benefit of the Ministry of Education and Science of the Russian Federation acted. Both ministries perform the general  coordination of activities for creation of a system. The Ministry of Telecom and Mass Communications of the Russian Federation bears responsibility for creation and maintenance of a federal segment of the IC "Contingent", its technological support, coordination of interdepartmental electronic interaction and is a technology operator of a system. The Ministry of Education and Science of the Russian Federation is engaged in methodological and methodical providing a federal system.

On December 29, 2016 the President of Russia Vladimir Putin rejected the law providing creation in the Russian Federation of the information system "Contingent of Students", reported on the Kremlin website.

Explaining the solution, the president said that the list of specific data which will contain in a system should be stated in the federal law. Besides, persons which will have an access to these data, and their responsibility should be defined.

On the practice which developed in Russia, questions of structure and data protection in industry information systems is a destiny of bylaws where it registers, the founder of "Academy of systems analysis", the research supervisor of the Center of urbanistics of Polytechnic University of Peter the Great Alan Salbiyev notes.

In this plan, of course, a nonsense that the president demanded to turn on these regulations in the text of the law, – Alan Salbiyev says. – But even the most secure systems are vulnerable therefore the maximum guarantees as it is about protection of the childhood, tomorrow of our power are necessary. As well as many experts, I support the solution of the president which was dictated by protection of interests of children. It is absolutely logical that he demanded to fill up the provisions of the law with more distinct theses about the one who will dispose of personal data in what purposes, and what structure of data will be. The president did not begin to trust bylaws which can be changed then quickly, and demanded to enter these questions in the law.

According to the expert, one of the incident reasons – replacement of the leadership in the Ministry of Education and Science in the heat of project implementation. It led to the fact that in department priorities, approach to the organization of the digital educational platform, use of digital technologies in education began to change, more hard work with presidential administration began. "So it was expected and it is logical that adjustments in ideology of the Contingent system will be required", – Alan Salbiyev considers. But in time departments could not approve the changed positions, as a result the president rejected the law.

Besides, on Contingent public listenings in full were not carried out, Alan Salbiyev notes. As a result many public figures have no all completeness of information that disturbs suspension of judgments.

The expert predicts that in the nearest future will make necessary corrections to the law and the Contingent system, perhaps, will be implemented in full to spring of 2017.

I am glad that even adherents of a board and chalk began to realize that the new generation consumes information in other format and other approaches in education are necessary. Without digital ecosystem these approaches cannot be provided. Without it the education system will not be able to be considered as competitive, – Alan Salbiyev is convinced.

The Federation Council approved the law

On December 23, 2016 the Federation Council approved the law on creation of an information system of accounting of pupils and sent it to the Russian President.

The State Duma adopted the law on creation InformSystems Contingent of students

On December 21, 2016 the State Duma adopted in the second and the third, final, readings the law providing creation in the Russian Federation of the information system "Contingent of Students" in which there have to be information about pupils, their progress and the educational organizations.

The bill should become effective since September 1, 2017, and the Contingent of Students system should form "step by step in the terms set by the Government of the Russian Federation, but no later than September 1, 2022".

2015. Creation of a system

A federal system for accounting of school students is created

At the end of December, 2015 a system was created. The Ministry of Telecom and Mass Communications and MegaFon signed the relevant acts of the performed works, including the act of readiness of a federal segment of a system for input in commercial operation.

MegaFon provided to the ministry the software distribution kit of a federal segment of a system, source codes, an album of screen forms, and necessary documentation. The customer paid the contractor 35.76 million rubles.

In the fall of 2015 of the Ministry of Telecom and Mass Communications for the benefit of the Ministry of Education and Science held an open competition^[1] for creation of the first stage of a uniform federal interdepartmental system of accounting of the contingent of students according to the main educational programs and additional general education programs (ICs "Contingent").

In each region for accounting of children and also providing services of electronic diaries and magazines own segments of the IC "Contingent" are created (cm an example of Moscow area), and a federal system will have to integrate these segments.

Bids were submitted by Rostelecom, Scientific Research Institute Voskhod, Kazan BARS Group, the Center of information technologies and systems of executive authorities (TSITIS), Ekaterinburg "Nau-service" (NAUMEN) and MegaFon.

Won against MegaFon which offered the minimum price - 35.76 million rubles (the starting price was 67.5 million). It is interesting that the text of the technical part of the application of MegaFon^[2] practically matches the similar text of the request of BARS Group^[3] up to drawings of the offered structures of subsystems. It can become a reason for the appeal of results of the tender FULL FACE, the interlocutor of TAdviser close to one of participants of the tender says.

MegaFon refused to comment on a situation. BARS Group could not provide comments of TAdviser.

FAS does not exclude a collusion of suppliers

Having studied information on tender, FULL FACE told TAdviser that coincidence of parts of technical proposals can be one of signs of collusion, but it is impossible to draw conclusions only on this basis.

It is necessary to analyze behavior of bidders, to look whether there was between them a real competition during trading and so on, - told in department.

FAS is ready to study in detail this question in case of receipt of the corresponding statement, representatives of antimonopoly service in a conversation with TAdviser added.

Terms

On development of the first stage of a federal segment of an interdepartmental system (including an analytical component of a federal segment) about one month of time is allotted (works start in November and will come to the end till December 15, 2015).

During the same time period the contractor should test information exchange of a federal segment with regional segments of an interdepartmental system of territorial subjects of the Russian Federation on the example of 10 pilot regions defined within the government contract.

Besides, the winner will have to develop prototypes of services of interaction of a federal segment with the systems of FTS, FMS, Pension fund, Ministry of Labor, Ministry of Health and Rosobrnadzor and also to test interaction of a system with a segment of the higher education.

Key issues which were resolved by specialists of BARS GROUP and Netrika companies (acted as subcontractors), became integration with different departmental data sources,  interaction of a federal segment of a system with already developed earlier regional segments. Prototypes of services of interaction of a federal segment with the systems of FTS, FMS, Pension fund, Ministry of Labor, Ministry of Health and Rosobrnadzor are developed and also interaction of a system with a segment of the higher education is tested. Much attention was paid to system performance which daily processes data bulks, to convenience of use, design and ergonomics of interfaces of the portal of a federal segment of the IC "Contingent" which the staff of several Russian departments will use.

The problems solved by a system

Creation of a federal system, officials hope, will allow to solve "a number of current problems of development of the general, professional and additional education", in particular, will bring to "quality improvement and efficiency of acceptance of management decisions, at the expense of the organization of effective interdepartmental electronic information exchange".

The first stage of a federal system of accounting of school students should be created in a month

As of 2015 the Ministry of Education and Science has no reliable information on the actual and predicted amount of the studying different age living in different territories and needing educational services follows from the technical specifications (TS) on creation of a system.

Problems of territorial planning at construction of the educational organizations are insufficiently effectively solved, there is no register of such organizations in current status, are separated or there are no data on grade levels and the achievements of students corresponding to them. Information on students are stored in separate departmental information systems, approaches to identification of students in different departmental information systems are also separated.

Tasks

In a federal system the different information about children - will be collected from the moment of the birth and registration of the child in bodies of ZAGS, namely: A full name, a floor, information on the place and date of birth, number of the birth statement, a series and the passport number (after its receiving), a registration address, the Insurance Number of Individual Ledger Account, the information about parents, about the place and the period of training, progress and achievements (including information on victories at the Olympic Games and tenders), the mastered educational programs, education documents and data on health. Besides, a system will contain information on educational institutions and teachers, statistical and the normative reference information.

• the centralized storage and updating of the register of the contingent of the data studying for ensuring integrity which are stored in regional segments of an interdepartmental system and information systems federal executive authorities;
• the centralized storage and updating of the register of the organizations performing educational activity for ensuring integrity of the data which are stored in regional segments and their synchronization during creation, reorganization and liquidation of the organizations;
• the centralized storage and updating of the register of pedagogical workers for ensuring integrity of the data which are stored in regional segments and their synchronization during creation, reorganization and liquidation of the organizations;
• providing summary analytical and statistical information on the basis of the data which are stored in regional segments for:
• obtaining information on the contingent of the students living in different territories;
• accounting of students in the organizations performing educational activity;
• identifications of the students who did not start training or stopped training for the purpose of prevention of homelessness;
• obtaining information on the impact of educational process on the state of health of students;
• forecasting of necessary number of places in the organizations performing educational activity;
• creation and providing at the request of users of a system or external information systems of a profile of the Person containing the integrated data on the person taking into account information from all key departmental information systems;
• ensuring information exchange about the contingent of students between departmental information systems, regional and high school segments of an interdepartmental system;
• increase in efficiency of information exchange between departmental information systems by creation of a uniform interdepartmental source of information on the contingent of students.

The ICs "Contingent" given in a federal segment will arrive from regional segments of all subjects of the Russian Federation, a segment of the higher education, information systems of federal public authorities and state non-budgetary funds. From a new system it will be possible to receive both statistical, and analytical information on different cuts.

Software requirements

The system software of a federal segment of the IC "Contingent" should consist of the operating system, DBMS, the application server or the Web server and also the server on information security support.

For creation of a federal segment of an interdepartmental system it is necessary to use the free software or software of the Russian production, said in terms of reference^[1].

Definition of "software of the Russian production" is given in the federal law "about the register of the Russian software" which was signed by the President in June, 2015. However, the law becomes effective only since January 1, 2016.
