NCI sued 187 million rubles from the state customer for an IT project in Crimea

In early July 2023, it became known that the National Center for Informatization (NCI), part of the state corporation Rostec, sued the state customer for almost 187 million rubles for the IT project implemented in Crimea.

According to reports, CNews we are talking about the modernization and development of the subsystem of the regional medical InformSystems as part of the Unified Medical Information System health care of the Republic of Crimea. The customer of the work was the state budgetary institution "" Crimean Medical Information and Analytical Center(CM IAC). The goal of the project was to achieve key indicators in the implementation of the regional program "Creating a single digital circuit in health care on the basis of a single state information system in the field of health care (EGISZ)."

NCI sued almost 187 million rubles from the state customer

The agreement was signed by the parties on August 26, 2020. Moreover, the NCI got in a row on an uncontested basis - in the form of a purchase from the only possible supplier. The work was to be completed by December 10, 2020.

On July 27, 2022, the NCI sent a lawsuit to the Arbitration Court of the Republic of Crimea demanding to oblige the customer to pay the entire amount under the contract due to the fact that the services were provided by the contractor in full. The respondent, in turn, stated that the selective inspection of the IAC CM subsystems affected by the contract revealed shortcomings.

However, the court sided with the NCI, obliging the customer to pay the full amount of the contract in the amount of 186.8 million rubles. As one of the evidence for the completion of the project, the ruling, as noted by CNews, provides a fragment of the defendant's recall of the statement of claim. It states that the customer sent the contractor a request (claim) to pay a penalty in connection with "the delay in the fulfillment of obligations, including the date when the contractor ends all measures and services (achieving the results of the provision of services) and the delivery of reporting documentation, the certificate of acceptance of the provision of services, invoice, payment invoice dated March 30, 2022."[1]
