The Ministry of Internal Affairs requires from T-Platforms to replace 9 thousand "sub-standard" PCs on Baykalakh

On June 18, 2020 it became known that the judicial proceedings continuing since December, 2019 between MINISTRY OF INTERNAL AFFAIRS and "T-Platforms" are connected with discontent of department with performances purchased a few years ago 9348 computers on domestic processors "Baikal-T1" which developed into the requirement to the supplier to replace the equipment. Without having agreed with outputs of the customer, the T-Platforms company — parent company of the developer of disputable chips — filed a petition for purpose of judicial computer technical expertize.

At the beginning of June, 2020 judges satisfied it — "for the purpose of a comprehensive, complete and objective investigation of circumstances on case, for explanation of the questions which arose when considering the case requiring special knowledge". According to the decision of Arbitration court of Moscow, expertize will be carried out by specialists of Institute of program systems of A.K. Eilamasjana RAHN.

The organization was selected for the reason that it locates necessary technical equipment and special laboratory conditions and also special technical skills and competences of experts. The institute has a laboratory equipped with "the certified measuring instruments which can be required for carrying out similar works". The cost of examination will be 960 thousand rubles. Warning for experts of criminal liability for making obviously false conclusion is separately registered in judicial determination.

Problem computers were transferred by T-Platforms to the Ministry of Internal Affairs within deliveries under two thematic contracts 2016-2018 of: basic whose execution was interrupted, and additional, concerning the undersupplied equipment on the first. Their total amount was 357.1 million rubles. This project cost freedoms to the CEO of T-Platforms Vsevolod Opanasenko and the former head of department of communication of department of IT, communication and data protection of the Ministry of Internal Affairs Alexander Alexandrov who were arrested in March, 2019. They are accused of the fraud committed by organized group or in especially large size that is punished by imprisonment for a period of up to 10 years. After year detention on March 18, 2020 both Opanasenko, and Alexandrov were sent under house arrest for three months. On June 11, 2020 after end of investigation concerning them proceedings were initiated. The next meeting will take place on July 10, 2020.

As noted in CNews, a detail of the published court's decision on purpose of examination in fact confirm reliability of the copy of a pre-judicial claim of the Ministry of Internal Affairs walking on the Internet in October, 2019 to T-Platforms. In this document of September 9, 2019 signed by the deputy chief of Management of the organization of logistics of the Ministry of Internal Affairs A.V. Trofimov it was noted that the warranty service life of goods makes 36 months from the moment of acceptance.

"It is established that the delivered goods do not meet the requirements of the contract, namely there does not correspond the operating clock rate, there is no possibility of expansion of RAM and a possibility of use of active cooling. The revealed shortcomings worsen utilization properties of terminal devices … Due to stated, I ask to perform replacement of goods in the terms set by contracts. Otherwise the Ministry of Internal Affairs will be forced to take arbitration court behind protection of the violated rights", it is told in a claim of the Ministry of Internal Affairs

Proceeding from fresh determination of court about purpose of examination, before Institute of program systems the question "in edition of the defendant" is raised: whether the supplied equipment conforms to requirements of technical specifications to contracts. Specifically it is about the maximum operating clock rate (obviously to the processor though it directly and is not specified), possibilities of expansion of the operating room (so in the text of the judgment) memories up to 8 GB, possibilities of use of active cooling, availability of the PCIe Generation interface 3 x 4.

As the CEO of Baikal Electronics company (the developer of a line Baykalov) Andrey Evdokimov as far as he knows reported in a conversation with CNews, at measurement of frequency of the processor rather disputable, in his opinion, technique was applied.

"For correct assessment of frequency of the processor it is necessary to follow a technique of measurement of frequency of the processor which is recommended by Baikal Electronics and which is uploaded at us to the website in open access. Anyone can check frequency: for this purpose it is possible to purchase a board with the Baikal-T processor on which just the same processor is installed, as in the equipment supplied to the Ministry of Internal Affairs to test it by the technique designated above, and it will show passport frequency", 'Andrey Evdokimov, the CEO of Baikal Electronics company noted'

At the same time Evdokimov notices that the frequency of the Baikal T processor not static, and changes dynamically, depending on loading and can be at some point lower greatest possible.^[1]

The second chance for Baykalov developers

Could not find spring of 2018 of the Ministry of Internal Affairs the alternative supplier of computers on domestic Baikal processors. Having interrupted performance of the contract and having refused services of Baykalov developers on behalf of T-Platforms company, the ministry restarted the multimillion tender for delivery of the equipment, however T-Platforms were the only applicant for the contract again.

They were defined by the winner of the tender and under the terms of the technical project will have to transfer in the Ministry of Internal Affairs of 7511 the automated jobs (AJ) as a part of the terminal device, the monitor, the keyboard and a computer mouse^[2].

Court with T-Platforms because of computers on Baikal processors

At the end of January, 2018 T-Platforms filed the petition for appeal about earlier made court's decision which permitted the Ministry of Internal Affairs to refuse purchase of a considerable part of computers which had to be delivered to department within the contract with the company. Information on it was published in a card file of arbitration cases. Appeal is planned for February 20.

The contract because of which the supplier and the customer came to court, was signed in November, 2016 and assumed delivery of the Ministry of Internal Affairs of 9348 automated jobs on Baikal-T1 processors for the total amount of 357 million rubles.

Follows from court's decision of the first instance that T-Platforms could not provide to the customer all required equipment at the scheduled time. The partial delivery was performed: The Ministry of Internal Affairs received 1837 computers for 71 million rubles.

The Ministry of Internal Affairs refused to accept other 7511 computers, motivating it with non-performance of delivery dates which, according to the Civil Code of the Russian Federation, are considered as the essential term of the contract.

T-Platforms continue to force the Ministry of Internal Affairs to accept computers on Baykalakh

In September, 2017 T-Platforms took legal action with the claim in which they demanded from the Ministry of Internal Affairs to accept the remained computers and to pay for them 286 million rubles. The court, however, in December rejected the claim, having considered non-compliance with delivery dates good cause.

The representative of T-Platforms Elena Churakova then explained that deliveries broke since the Ministry of Internal Affairs delayed advance payment and did not give the company information necessary for contract performance^[3]. According to her, T-Platforms even suggested to pay penalties and penalty fee for delivery delay, but it did not happen because of the special clause prohibiting acceptance after contract term.

The hard line of the Ministry of Internal Affairs can speak October arrest of the chief designer of the Ministry of Internal Affairs Andrey Nechayev. The source familiar with managers of T-Platforms, and the source close to the Ministry of Internal Affairs held such opinion. Nechayev was one of ideologists of transfer of the Ministry of Internal Affairs on the equipment based on domestic microelectronics, "and its position played a role at the time of formation at the Ministry of Internal Affairs of interest in the computer on Baykalakh, Churakova noted in December.

Development of the system of an electronic queue on Baikal-T1 processors

The Ministry of Internal Affairs at the end of December, 2016 selected the system developer of an electronic queue which will be created using domestic electronic component base and is set in departments of providing public services^[4].

The "Special Equipment and Communication" scientific and production association of the Ministry of Internal Affairs of the Russian Federation acted as the customer of a system ". The proposals on tender were submitted by three companies – Philosophy.IT, "DIIP 2000" and "Independent Test Center — the Special Test".

The request of Filosofii.It company which offered not the bottom price of the contract (197.5 million rubles) became victorious, but was ahead of other participants on degree of development of technical proposals.

"Philosophy.IT" should design and develop till December 15, 2017 a standard set of an e-queue system for 330 departments of the Ministry of Internal Affairs in regions of the country. Electronic boards for display of number of an electronic queue (2500 units), 500 displays for the general display of an electronic queue, 500 terminals for interaction with the visitor, 500 automated workplaces for processing of an electronic queue and also 400 switches, software and documentation should be a part of a set.

The terminal for interaction with the visitor and a workplace for processing of an electronic queue should be constructed on the basis of an automated workplace with the Baikal-T1 processor. All hardware which are a part of a standard set should be made in the territory of the Russian Federation. The software necessary for functioning of a standard set should be based on Open Source.

As for reliability of a standard set, according to documentation, the complete average term of its service before write-off should make not less than 3 years. At the same time it should work in a continuous duty of 7 days in week, 24 hours a day, 365 days in a year.

Contract with T-Platforms

At the beginning of October, 2016 the Ministry of Internal Affairs announced a tender on purchase of computers for acceptance of theoretical examinations on driver's licenses. The starting price of purchase was 357 million rubles^[5].

The Ministry of Internal Affairs will hold exams for the rights using computers on the Russian processors

In November the protocol according to which only one application - from T-Platforms company was submitted for an auction was published. Its offer was recognized to relevant requirements of purchase. The auction is recognized cancelled.

In the same month the Ministry of Internal Affairs and T-Platforms signed the contract.

Within purchase of the Ministry of Internal Affairs was going to receive 9348 computers on Baikal-T1 processors. Proceeding from the purchase price the cost of one PC leaves about 38 thousand rubles. Each set should include the terminal device (the processor with clock rate not less than 850 MHz, 2 GB of the DDR3 RAM, 6 USB ports), the 23-inch monitor, the keyboard and a mouse. The warranty service life should make not less than 36 months.

The directions of delivery include 8 departments of the Ministry of Internal Affairs in Moscow, St. Petersburg, Rostov-on-Don, Samara, Yekaterinburg, Novosibirsk, Irkutsk and Khabarovsk. The biggest batches should be sent to Moscow (1777 computers), Samara (1614) and Novosibirsk (1520).

The contract date was designated August, 2017.

The plan of the guaranteed state procurements of the Russian microelectronic products

At a meeting of the government commission on application of IT for quality improvement of life, a past under the leadership of the prime minister Dmitry Medvedev on April 5, 2016, the draft of the plan of the guaranteed state procurements of the Russian microelectronic products was submitted (the copy of the document is available at the disposal of TAdviser).

The Ministry of Internal Affairs will become the largest consumer of domestic electronics in 2016-2018, according to the document.

The police will work on the computers equipped with Baikal processors, and computing powers of the Ministry of Internal Affairs will be replenished with servers based on Elbrus

In particular, for 17.2 billion rubles of the Ministry of Internal Affairs it intends to purchase 17.2 thousand servers based on processors Elbrus-4C and Elbrus 8-C. INEUM named after I. Brook and MCST will become Solution provider.

In 2017-2018 RSU Ministry of Internal Affairs will be engaged in construction of DPC in which these servers will be placed. For this work it is going to spend 13.7 billion more rubles.

Telecommunication equipment in DPC of the Ministry of Internal Affairs expects to buy on 2.4 billion rubles, having selected contractors during the competitive procedures.

In addition the ministry intends to equip jobs with 110 thousand Meadowsweet computers on Baikal-T1 processors. Their cost, according to the plan, will be 3 billion rubles. Developers of computers and processors - T-Platforms and Baikal Electronics will have to become suppliers.

The Ministry of Internal Affairs expects to purchase monitors for Meadowsweet for 1.2 billion rubles, having selected contractors at tender.

In the protocol according to the results of a pravkomissiya meeting on April 5 it is said that by June 2, 2016 the Ministry of Finance, the Ministry of Telecom and Mass Communications, the Ministry of Internal Affairs and other departments which the plan of the guaranteed purchases of microelectronics concerns should finish and provide it to the government its financial and economic justification.
