Retentiva Distribution Company — the wholesale supplier of accessories for digital equipment in the Russian market. The company was created in 2006. The total quantity of regular customers of RDC contains more than hundred trade enterprises. The company is an official distributor of such brands as Xiaomi, YI, Havit, Jinga, Fossil and Skagen.

The Moscow court declared RDC bankrupt

On August 27, 2020 Arbitration court of Moscow in the claim of bank "Opening" declared RDC bankrupt. During court session the representative of credit institution asked to turn on in the register a debt of official distributor smartphones Xiaomi in the amount of 666.4 million rubles.

Bankruptcy of RDC was reported by Kommersant with reference to the court's decision published in its card file. The judge of Arbitration court of Moscow Larisa Kravchuk recognized reasonable requirements of bank "FC Otkrytiye and entered insolvency proceeding (observation) concerning Retentiva Distribyyushen Company LLC. Valeria Bakina from the union of AU Semtek is appointed the interim manager of RDC.

According to lawyers, some transactions which were made by the debtor can be appealed by the managing director. Whether signs of deliberate bankruptcy in actions of the management will be set, it is unknown. But if there is enough corporate property for implementation of payments to creditors, there is a chance that RDC will leave bankruptcy and will be able to continue work in the market, having cleaned from debts.

Whatever impressive was the writ of execution issued by court, it should be considered only as the input ticket in insolvency proceeding, but not as a debt repayment guarantee — the senior partner of PEN & Paper Bar Valery Zinchenko noted in a conversation with the edition.

The company of Marvel Distribution hoped that chances of debt collection will increase involvement of the controlling debtor's persons to subsidiary liability during bankruptcy.

One of the largest creditors of RDC — GPB Factoring of Gazprombank — demands 714 million rubles. By September 12, 2020 requirements of 201 million rubles from Mobilidi company for deliveries of the Xiaomi smartphones and from structure Marvel Distribution for 99 million rubles are met.[1]

Sberbank decided to make bankrupt RDK

On January 13, 2020 it became known of plans of Sberbank to make bankrupt official distributor of Xiaomi in Russia — RDK. Interfax with reference to the notification of the State Bank on Fedresursa reflected in a system SPARK-Interfax reports about it.

Besides, Sberbank submitted the same application concerning Alden Management LLC which possesses 99% of RDK. At the same time it is not specified in what arbitration court hearing of cases is planned.

Sberbank always works in full accordance with the current legislation of the Russian Federation. Messages about intention to take legal action with statements for bankruptcy were published by Sberbank in connection with improper execution of obligations from RDK LLC and Alden Management — Reported Interfax LLC in the press service of Sberbank.

It is not the first claim to the seller of electronics. At the end of 2019 "GPB-Faktoring" expressed the intention to make bankrupt RD" through court. By January 13, 2020 in its relation case of a debt understands 714.5 million rubles.

Besides, the statement of Otkrytiye bank for recognition of RDK by the bankrupt is under consideration of Arbitration court of Moscow, trial on case will take place on March 6, 2020.

In 2019 the Arbitration court of Moscow obliged to pay RDK  to 201 million rubles of Mobilidi company according to the action of debt on payment of the delivered smartphones, follows from the court's decision published on November 26. RDK did not pay goods for  129 million rubles, and  72 million more rubles. Mobilidi required as a penalty. The dispute concerned deliveries of the Xiaomi smartphones.

The RDK company founded in 2006 is engaged in sale of smartphones in Russia and digital equipment from China. Among brands with which it works —  Xiaomi, Jinga, XiaoYi, Fossil. RDK is selected by one of suppliers of smartphones on domestic to the operating system "Aurora" for officials.[2]
