Stealing at traffic police

In the afternoon on December 11, 2012 the director of business development of Hitachi company Yakov Fominykh (32 years) was gone. Last time Fominykh saw in his Audi RS3 car. This day it was caused in traffic police of Khoroshovsky district: it was suspected that it fled the place of road accident. After a campaign to inspectors the man completely was gone, and found his car later burned down.

"From two o'clock in the afternoon on December 11 at the husband phone is switched-off. Inspectors who saw it last time confirmed that the call was wrong, and told that released it from traffic police still during the lunchtime, - Yakov Fominykh's wife Oksana tells, - found Yasha's machine near Moscow at night".

It became clear later that killers kidnapped the businessman Yakov Fominykh from walls of traffic police, having enticed it using anonymous reporting of accident there.

- Not to spend time for shadowing Fominykh, bandits thought up a method how to trap him, - told in March, 2013 Life News a source in law enforcement agencies. - They called traffic police and reported that Fominykh arranged road accident and fled the scene. The manager was called in police for analysis. And there it was already watched by bandits.

- According to the inspector Sergey D. (in the interests of the investigation his name are not disclosed. - An editor's note) which the last was seen by Fominykh live, they missed each other on the traffic police parking, - says a source of Life News. - After the employee of road inspection struck the foreign car of the top manager of Hitachi off the register, they went to the check point. But the post of the person on duty was reached only by the inspector. Criminals needed only several minutes silently to twist the victim and to display its foreign car from the parking practically from under a nose of police.

The improbable dexterity of criminals described by Sergey D. seemed to the investigation improbable at once. The decision to interrogate it by means of a polygraph was made. However data retrieveds of the lie detector unambiguously demonstrated that the inspector tells an honest truth.

- We did not kill him, only took away from traffic police, and all! - the 23-year-old native of Ukraine Daniil Ruforny said on interrogation. - Gave the kidnapped person to accomplices knew of nothing about his destiny any more.

Two more bandits expected the machine with the captive in the forest near Tver - they and finished from Fominy.

Tortures in the forest

Most of all errors which became important proofs for the investigation criminals committed already on site murders.

- Judging by the expert opinion, they were not going to kill Fominykh, they needed to obtain some information, - reports a source in law enforcement agencies of the Tver region. - Near the place of detection of a body top menezhdera investigators found that place where bandits tortured two hours, and then killed Yakov Fominykh.

Having tied unfortunate to a tree an adhesive tape, bandits, working according to the scheme of the 90th that is called beat out information from the victim using the iron and a baseball bat.

It became known later that criminals required from Yakov Fominykh to call the login and the password to an electronic system "Bank client" to withdraw money from its personal accounts ($2 million).

Experts established that they to Yakov Fominykh kidnapped in Moscow broke a neck. The investigation is sure that a crime was committed by the experienced murderer.

After detection in the Tver region of a corpse of 32-year-old Yakov Fominykh criminalists could tell precisely that before death the man was cruelly tortured. Having exhausted the victim, the murderer broke to him a cervical vertebra.

- The dead has multiple fractures, including a backbone, thermal burns, hematomas. However the fracture of the third cervical vertebra became deadly. In other words, unknown, having received from the victim all necessary, just killed it, - reported in the press service of the Investigation Department of the Russian Investigative Committee in the Tver region. - The nature of the injuries got by the dead gives to us a reason to think that murder was committed by professionals.

Yakov Fominykh's death came after one of criminals stepped to him on a neck a leg and broke a backbone — told a source of Izvestia. — Presumably it was made by the organizer of crime Andrey Shevyakov.

Detection of the burned-down machine

The Audi RS3 car, the belonging Fominykh, police officers detected burned in the territory of Avtomobilist-2 GSC in the settlement of Rzhevka of the Solnechnogorsk district of the Moscow region.

Later investigators found eyewitnesses who could describe appearance of the criminals who were setting fire to Yakov Fominykh's car.

Two men who are setting fire to the Audi RS3 car in a garage and construction complex near Zelenograd late were noticed by locals at night.

- It was very dark therefore we with the friend noticed process of firing of the machine at once, - one of eyewitnesses says (in the interests of the investigation names of witnesses are not disclosed. - Editor's note). - We approached closer and saw that two men poured out something in inside of the foreign car and escaped. Fire flashed from within at once, doors were open, and the car is started

Eyewitnesses rushed for instigators, but did not catch up as criminals managed to get into the car and to disappear.

- They were an average constitution and growth, approximately years up to 30, - the witness continues. - And I heard their speech... It was either Moldavian, or Ukrainian. They, naturally, did not react to our requirement to stop. We called firefighters and police at once, but from Audi there were coals. We began to check at once whether the car belongs to someone from locals, but it turned out later that it here was never seen. Most likely, just saw the thrown garage complex and contracted here.

The police arrived to the crime scene almost in an hour. By this time the car burned out completely. A bit later from a big fire of the operativiki found a bag with documents and cash cards addressed to Yakov Fominykh in several meters.

Eyewitnesses in detail described appearance of instigators to investigators.

Police officers transferred all materials to Territorial Office of Investigative Committee where criminal case under the Article 105 of the Criminal Code of the Russian Federation Murder was brought later.

Right after detection of the burned-down Audi law enforcement authorities assumed that Yakov Fominykh's disappearance has criminal character: near machine found its documents and bank cards.

In representative office of Hitachi holding in Russia confirmed to Life News information on loss of one of top managers. Fellow workers actively help the investigation and involve in search of volunteers.

"Yakov works for us at a position of the development director, - reported in "Hitachi Date to Sistems", - last time he came to work on December 11. We cooperate with the investigation, but, unfortunately, we cannot state any reasons for Yakov's kidnapping".

The volunteer organizations joined the search of the top manager. Yakov Fominykh's relatives do not lose hope that he is still alive: there is a version of stealing for the sake of the redemption.

Detection of a corpse

On December 19, 2012 the Investigative Committee announced detection by Yakov Fominykh's dead. The body with signs of violent death was found on December 12, 2012 at the carriageway conducting from the city of Torzhok towards the settlement of Ostashkovo of the Tver region. Missing Yakov Fominykh, said in the statement of Investigative Committee was him. On this fact criminal case on signs of the crime provided by Part 1 of Article 105 of the Criminal Code of the Russian Federation (murder) is brought.

Fominykh found a breathless corpse the bulldozer driver who was clearing away the road from the city of Torzhok to the settlement of Ostashkov. On the 29th kilometer the man noticed that from snow the clothes fragment is visible. Having stopped, the driver dug out a snowdrift in which the dead person lay, and called the police.

Police officers who were told about detected on the route Torzhok - Ostashkovo a corpse, at first decided that the dead - the long-distance truck driver who fell a victim of assault. At the killed man was not at itself either values, or documents.

Robbery was originally major version of death of the 32-year-old top manager of Hitachi Yakov Fominykh detected on the 29th kilometer of the highway Torzhok - Ostashkovo in the Tver region.

At the victim it did not appear at itself documents and any valuable things. The output from this situation was one - the man was robbed, and the car was stolen.

This version was spoken well also by other fact - the body was found far from the locality at the road.

- The proximity of the route, lack of any values at the killed are the bases to believe that the found body belongs to someone from long-distance truck drivers, - the senior assistant of the head of SU of the IC RF on the Tver region Valery Pavlov commented on a situation of Life News. - But detailed inspection of the scene and expert opinions allowed investigators to identify the personality of the dead and to come to other version of crime.

The corpse of the dead remained more than a week unidentified. However the Tver police officers, having detected expensive underwear on the dead, came to a conclusion that the resident of the capital therefore information on the killed was sent to Moscow is able to afford such things, most likely.

- We paid attention that the man wore expensive underwear. It is on sale only in one shop in the capital, - told a source in the investigation. - It also suggested an idea to check the people who were gone in Moscow.

- Relatives identified the man, - explained Life News in the press service in the Investigation Department of the Russian Investigative Committee in the Tver region. - The investigation continues. It is complicated by the fact that on site there is no detection of a corpse left owing to weather conditions explicit traces of murderers. Video of records of surveillance cameras on which, perhaps, the punishment moment got too is not revealed yet.

It became clear later that stole the tablet in which data on the major transactions were stored from the killed Yakov Fominykh. Now his former subordinates fell under suspicion.

The died manager before death was subjected to cruel tortures - bandits as field investigators assume, demanded from Fominy passwords to the files stored in his tablet computer.

Personal data of clients and documents on the forthcoming transactions of the director of business development of the Russian representative office of Hitachi could also become the true purpose of organizers of crime.

On one of the versions of the investigation, first of all this information could be useful to the dead's colleagues.

- About loss of the tablet we were told by the close friend Fominykh, - the source in law enforcement agencies shares with the correspondent of Life News. - Yakov stored the customer base to which none of his colleagues had access in it. He practically did not use the working computer and wrote all important working information only in the tablet which carried with itself(himself) everywhere.

As police officers managed to find out, in the nearest future Yakov Fominykh has to be transferred to work in the American office Hitachi. It was planned that vacant position of the director of business development of the company will be held by someone from his former subordinates.

Having taken control of the customer base of the top manager, colleagues could use them for the conclusion of new contracts and, respectively, receiving personal bonuses.

- One more "plus" in a version moneybox with colleagues is a place of commission of crime, - our interlocutor continues. - Fominykh killed in the Tver region and bandits of one of local groupings were probable offenders. And at Hitachi the plant in Tver is under construction. His employees could come into contacts with local criminals easily.

The criminalists examining the place of punishment also assumed that local "mobsters" acted here.

- For a certain remuneration they agreed not only to steal so outstanding figure as Fominykh, but also tortures to beat out from it information, - continues a source in law enforcement agencies. - Working roughly and obviously nonprofessionally, all of them did not plan murder. All damages including burns which, under an assumption of experts, are caused by either the iron, or a blow torch did not pose a threat for life.

Field investigators consider that the tablet and passwords were not an ultimate goal of contractors. The organizers of crime who ordered tortures of "client" obviously expected more extensive information which, most likely, Fominykh carried away with himself in a grave.

It should be noted that, according to the people knowing the killed some days before death Fominykh considerably was nervous as if having a presentiment of the approaching trouble.

- For example, Yakov's wife remembered that he badly ate and slept and also was extremely scattered. However he did not tell about any threats to the relatives, - says a source of Life News.

It was reported that some days before his murder Yakov Fominykh planned a series of transactions, large and important for the company.

March, 2013: Detention of thieves

On March 5, 2013 the staff of criminal investigation department of the ATC on SAO delayed three suspects of Yakov Fominykh's murder, - told Life News in the press service of capital police.

The criminals who stole, torturing and killed 32-year-old Yakov Fominykh managed to be tracked down thanks to a call to traffic police on which all plan of killers was tied. In the known day and hour under walls of department of a state traffic inspectorate of the businessman three criminals who received the order for its stealing waited.

On March 7, 2013 the police reported that it solved Yakov Fominykh's murder. The native of Ukraine Daniil Ruforny after detention confessed to everything and even went to the transaction with the investigation, having agreed to hand over the accomplices. However, his 38-year-old companion Sergey Korneev, the visitor from Krasnodar, did not begin to deny the fault too, but only in stealing.

Actions of this part of the gang which did not dirty a hand blood also were fatal for all five of criminals.

Investigators were confused from the very beginning by a story with a call Fominykh in GAI. To field investigators charged to work this moment, and police officers could be hooked for this thread. Having untwisted it, detectives found one of criminals then behind him shadowing began.

As a result it was succeeded to set all five members of gang. What is interesting, one of them during investigation - from the middle of December, 2012 - committed other crime and now is in the Butyrsky insulator.

- Three thieves were delayed on March 5, two of them did not begin to deny the fault, only disowned from the murder, - the interlocutor of Life News explains. - The fourth bandit already to the pre-trial detention center, and here the fifth managed to run away to Ukraine.

Shevyakov is the expected organizer of stealing

The organizer of stealing, according to the investigators, is Andrey Shevyakov (34 years) delayed the day before, the owner of the Shadis LLC company which is engaged in transportations of passengers on minibuses in the northwest of Moscow. It had to be taken with special accuracy - police officers had information that the bandit carries with himself in the Infinity QX56 car the improvised explosive device.

- Shevyakov is a many-sided personality: on the one hand - the large businessman whose share taxis service the northwest of the capital with another - he is suspected of stealing, - one of police officers told Life News. - It moved on the most solid jeep, and in a luggage carrier carried a set of huge knives and a bomb: gasoline, gunpowder and accumulator.

Being afraid that the criminal will decide to blow up himself and people around, police officers did not begin to carry out capture in the capital. They traced Andrey Shevyakov's Infinity, brought it to the settlement of Rublevo in Moscow area and already there began to work.

Fortunately, it was succeeded to do without the victims. However, for neutralization of the explosive device into place called rescuers of the Ministry of Emergency Situations and specialists from engineer service.

In Savelovsky district court of Moscow where arrest of three detainees the day before took place, Andrey Shevyakov said that he is innocent.

- All this big error, - Shevyakov told the family who came to support him.

Nevertheless the judge Vyacheslav Polovnikov sent Shevyakov and two his accomplices to the pre-trial detention center for the next two months until criminal case is investigated.

Investigators announced also that they set motive of murder: Yakov Fominykh was kidnapped for the sake of $2 million which were on his personal accounts in the Cyprian banks. Izvestia was reported about it by a source close to the investigation, having added that accomplices of the expected organizer of punishment Andrey Shevyakov did not know about his true plans.

- Andrey Shevyakov is connected to this case as the organizer — told Izvestia a source in the Moscow intelligence agencies. — Money on Yakov Fominykh's accounts in the Cyprian banks — about $2 million was his purpose. He completely did not bring the accomplices up to date. Told Ruforny that beats out a debt from the acquaintance, and to Korneev — that revenges the ex-wife's lover.

Sergey Korneev and Daniil Ruforny gave confession and concluded the bargain with the investigation. However they claim that they participated only in stealing, but did not torture and did not kill the victim. Andrey Shevyakov the day before in court completely denied the fault.

The leader of criminals according to Article 105 of UK ("Murder") is threatened by punishment up to life imprisonment, his accomplices pass according to Article 126 of UK ("Stealing") so far, on it the maximum punishment — up to 15 years of colony^[1].
