2023:10 claims from the Central Bank due to problems on the company's website

On July 19, 2023, it became known that the Bank of Russia (Central Bank) filed 10 lawsuits with the Moscow Arbitration Court against Vladimir Tikhomirov, director of the IT department of the Ingosstrakh insurance company. The reason for numerous proceedings was the malfunctions of the insurer's website.

According to CNews, all claims were sent within four months - starting from March 20, 2023. Nine out of ten proceedings were initiated on the grounds of administrative violations of Part 3 of Article 14.1 of the Administrative Code - carrying out entrepreneurial activity in violation of the requirements and conditions provided for by a special permit (license). If guilty, the defendant in each of the cases faces a fine of 500 to 2000 rubles.

Another claim is related to the implementation of entrepreneurial activities without state registration as an individual entrepreneur or without state registration as a legal entity (part 1 of the same article). In this case, a fine of 1.5 thousand to 2 thousand rubles can be imposed on citizens, from 3 thousand to 4 thousand rubles on officials, from 30 thousand to 40 thousand rubles on legal entities.

The reason for the proceedings was the problems when concluding an OSAGO agreement in electronic form through the Ingosstrakh website. The Central Bank received an appeal from Natalia Tsaplina, who could not use the corresponding service. During the proceedings, it was established that Tsaplina initially did not attach all the required documents, but in the future there were failures.

The judges had questions personally to Tikhomirov, since he was appointed responsible for the technical support (correctness) of the work of the official website of Ingosstrakh when concluding OSAGO contracts. Moreover, at the time of the failure, Tikhomirov was at the workplace. Therefore, as noted, Tikhomirov's improper performance of official duties entailed "the inability to conclude an OSAGO agreement in the form of an electronic document, which is a violation of licensing requirements." In other words, the defendant was inactive when the problem occurred.

According to one of the already issued court decisions, a fine of 3 thousand rubles was imposed on Tikhomirov. Another claim has been dismissed and others are either being considered or have not yet been accepted for production.[1]
