OSAGO Compulsory civil liability insurance

Compulsory insurance of civil liability of vehicle owners (abbreviated OSAGO - compulsory insurance of motor vehicle liability) is a type of liability insurance that appeared in Russia on July 1, 2003 with the entry into force of Federal Law No. 40-FZ of April 25, 2002 "On Compulsory Insurance of Civil Liability of Vehicle Owners." OSAGO was introduced as a social measure aimed at creating certain financial guarantees in relations regarding compensation between participants in automobile accidents. The idea of ​ ​ this type of insurance is not new: it operates in many countries of the world and within the framework of transnational agreements - for example, the "green card." The peculiarities of "auto citizens" in Russia at the present stage are the state establishment of insurance rules and state regulation of tariffs.

Why do I need OSAGO

This car insurance is needed to protect people who have been involved in road accidents. If you crashed or damaged another car, a shop window, a fence in your car, crippled someone and are to blame for an accident, then the insurance company will pay for these losses to the victims within the insurance amount.

The cost of the OSAGO policy and restrictions on payments are fully regulated by the state. This guarantees the low cost of insurance and the obligation to pay in the event of an accident.

The maximum amount of insurance (payment) is:

  • up to 160 thousand rubles for causing harm to life and health to each victim;
  • up to 120 thousand rubles for damaged property to one victim or up to 160 thousand rubles for all.

The amount of these payments can be increased due to voluntary civil liability insurance (DSAGO). This service is offered by many insurers - for a small surcharge, the upper threshold of these numbers can be increased several times.

Without an OSAGO policy, you do not have the right to drive a car (a fine is due for this), you cannot register your car with the traffic police. Each driver who gets behind the wheel of a car must be entered into the OSAGO policy, or it must mark that the number of drivers is "without restriction."

The OSAGO policy must be stored together with documents for the car and presented to the traffic police inspector at the first request. If you forget him at home, then the representative of law enforcement has the right to send your car to the parking lot. We recommend you don't throw out old policies for five years after they end - this could make your future insurance cheaper.

You need to know that the OSAGO policy does not protect against theft or damage to your car. For full protection of the car, it is recommended to purchase a CASCO policy.

How the price of the OSAGO policy is calculated

Inexperienced pay more

Despite the fact that the law establishes the basic OSAGO tariff, many factors affect the cost of the policy. The most expensive OSAGO will cost young drivers and drivers with driving experience of up to three years. Both factors increase the cost of OSAGO (increasing coefficients from 1.3 to 1.7 are used), therefore, when calculating the tariff, it is necessary to take into account the age of the driver (up to 22 years) and the number of years of practice while driving.

Insurance rates for OSAGO have different costs for emergency and accident-free driving. Experienced drivers who have not created an accident for several years are provided with significant discounts; the more accident-free driving experience, the higher the amount of incentive. Since several drivers are often allowed to drive a car, it is considered permissible to apply this reduction factor for OSAGO only taking into account the driving history of each of them.

The cost of OSAGO increases if the number of drivers admitted to driving the vehicle is not limited (a coefficient of 1.7 is added to the tariff).

Muscovites pay the most

How OSAGO is calculated is influenced by the region in which the car is "registered": insurance tariffs are significantly increased for Muscovites and Petersburgers (increasing coefficients 2 and 1.8 are used, respectively); in the Moscow, Leningrad regions and in large cities of the Russian Federation, the increasing coefficient is 1.3-1.7, but in unprofitable regions a decreasing coefficient is used.

And, of course, the cost of a car citizen depends on the car itself, or rather, on the engine power. Since the amount of horsepower affects the cost of insurance in both directions, owners of low-power cars can consider OSAGO cheap, and strong cars expensive.

Sales of electronic OSAGO in Russia increased and occupied 62% of the market

The Russian Union of Auto Insurers (RSA) has identified 10 leading regions in terms of the share of highly unprofitable OSAGO contracts for the period from July 1, 2022 to June 30, 2023. The organization disclosed the results of its study in August 2023.

The first three anti-rating included the Chechen Republic, where 77% of all concluded "auto citizens" agreements in the region are transferred to the pool, as well as the Republic of Dagestan with a close indicator of 76% and Primorsky Territory with a share of such agreements in 53% of the total number of OSAGO agreements concluded in the region.

RSA identified 10 leading regions in terms of the share of highly unprofitable OSAGO contracts

Electronic settlement of OSAGO policies is launched in Russia

On July 15, 2023, a law introducing an electronic settlement in OSAGO will enter into force. At the end of June 2023, the head of the All-Russian Union of Insurers (ARIA), the Russian Union of Auto Insurers (RSA) and the National Union of Liability Insurers (NSSO) Evgeny Ufimtsev named the advantages of the innovation.

From July 15, 2023, insurance companies will have to provide an electronic settlement on OSAGO when registering an accident on a European protocol with an application through the State Public services portal, and will also be able to voluntarily provide a full online settlement service. At the same time, it will remain possible to issue a payment for OSAGO in the traditional way - by visiting the office of the insurance company.

According to "Банки.ру," not all insurers are ready to resolve insurance cases completely remotely. Many companies accept scans of documents and photos of the inspection of the consequences of an insured event through their mobile application (this allows you to exclude the fact of fraud and make sure that the risk covered by insurance has been realized). But not all insurers are ready to accept an online application to settle the insured event. To do this, it must be signed with an electronic digital signature. As explained in the All-Russian Union of Insurers, changes in the legislative framework allow you to sign applications for insurance compensation for EP. It is possible to use an enhanced qualified EP, which has long been used in various fields. The second option is an enhanced unqualified EP (UNEP). It is to him that insurers are now of maximum interest. The UNEP key must be created on the "Public services." However, for now, insurers prefer to accept applications for the settlement of an insured event on paper.[3]

2022

The number of contracts with legal entities decreased by 13% to 54 thousand.

The number of OSAGO contracts concluded with legal entities in 2022 decreased by 13% compared to 2021 - to 54 thousand. In the segment of individuals, the decline amounted to 5%, to 121 thousand. Such data from the Central Bank of the Russian Federation were published in early June 2023.

As Kommersant writes with reference to the statistics of the regulator, in 2022, insurance companies collected 2.4 billion rubles and 2.1 billion rubles for legal entities under OSAGO in the segment of individuals. The average premium was 20 thousand and 41 thousand rubles, respectively. According to the publication, we are talking about record fees in the segment of individuals, which is mainly associated with the price factor.

Experts associate the reduction in the number of concluded OSAGO contracts with the concealment by drivers of the status of a taxi driver

The growth of the premium was due to the expansion of the tariff corridor, said ACRE Alexey Bredikhin, director of the group of ratings of financial institutions. Since taxi insurance is unprofitable, all insurance companies keep tariffs for them at the maximum possible level. The cost of a taxi policy is much higher than for other cars, this prompted some car owners not to indicate that the car is used as a taxi, explains Alexey Bredikhin. In 2022, OSAGO contracts were concluded with 170 thousand taxis. OSAGO fees increased by 21.1% - Central Bank of the Russian Federation

In 2022, insurance fees for OSAGO in Russia reached 273.1 billion rubles, an increase of 21.1% compared to 2021. This is evidenced by the data of the Central Bank of the Russian Federation, published in mid-March 2023.

According to the regulator, the growth of compulsory car insurance occurred against the background of a sharp rise in price of spare parts. Insurers were forced to raise prices, while the number of concluded OSAGO contracts also increased.

In Russia, OSAGO fees for 2022 increased by 21.1%.

The Central Bank noted the expansion of the corridor of the basic OSAGO tariff, which made it possible to take into account the characteristics of specific drivers and car owners when selling insurance, correlating the cost of policies with different levels of risk.

In 2022, the average cost of an OSAGO policy increased by almost a thousand rubles, to 6.6 thousand rubles. At the same time, the average insurance payment increased to 70 thousand rubles. In total, in 2022, car insurers paid 159.8 billion rubles (+ 11.3%) due to an increase in the number of insured events and an increase in payments. The number of complaints about the settlement of losses decreased by 2.3%.

The availability of OSAGO for young and inexperienced drivers, taxi owners  of parking cars, as well as drivers who have repeatedly been the culprits of accidents, supported the launch in April 2022 of a reinsurance pool, the members of which should be all insurers carrying out this type of insurance, added to the Central Bank.

Review of key performance indicators of insurers

Growth of total OSAGO fees by 16%, to 273.5 billion rubles - RSA data

At the end of 2022, the total amount of payments to Russian insurance companies under OSAGO policies increased to 157.3 billion rubles from 153 billion rubles a year earlier. At the same time, in 2022, the number of road accidents significantly decreased, as a result of which the declared and settled losses under OSAGO turned out to be 6-7% less. If the number of accidents remained the same, the cumulative increase in payments would amount to more than 10 billion rubles, significantly affecting the OSAGO economy. This was announced in early February 2023 by the Russian Union of Auto Insurers (RSA).

Total OSAGO fees in 2022 increased by 16% and amounted to 273.5 billion rubles against 235.9 billion rubles in 2021. This will make it possible to form increased insurance reserves, which in the future will be aimed at compensation for damage to victims under contracts concluded at previous insurance rates, however, the amount of payments for which will be calculated in the new conditions - after the rise in price of spare parts and an increase in prices in directories, noted in the RSA.

OSAGO insurers' fees increased by 16% in 2022

The average payment for OSAGO in the whole of 2022 amounted to 76,858 rubles, an increase of 10% compared to the average payment in 2021 (70,124 rubles). However, since June, when new directories for the average cost of spare parts came into force, the growth in the average payment month to month has been significantly higher. So, in June 2022 (on June 19, new directories of the average cost of spare parts came into force, in which the average cost of spare parts increased by 30.6%), the average payment for OSAGO increased compared to the average payment of June 2021 by 15% (75,514 rubles in June 2022 against 65,662 rubles in June 2021).

Then the average payment grew by several percent monthly, reaching 91,315 rubles by December 2022, which is 23% more than the average payment of December 2021 (74,269 rubles) and 28% more than the average payment of January 2022 (71,379 rubles). Due to a sharp decrease in car sales by 4%, the number of OSAGO contracts decreased - from 42.1 million to 40.3 million units.[5]

OSAGO payments increased by 21%

At the end of 2022, the average OSAGO premium in Russia amounted to 6,793 rubles against 5,599 rubles a year earlier (an increase of 21%). For passenger cars of individuals, the growth of average premiums was lower: the average premium in 2022 amounted to 6370 rubles against 5441 rubles in 2021 (+ 17%). This is evidenced by the data of the Russian Union of Auto Insurers (RSA), which were published on January 24, 2023.

According to the statistics presented, in terms of casco policies, according to the Bureau of Insurance Histories (BSI), in 2022 the average premium increased slightly and amounted to 40,052 rubles against 39,805 rubles in 2021.

According to analysts at the NKR rating agency, in 2022, total OSAGO payments in the event of harm to life and health fell to about 6 billion from 6.6 billion rubles in 2021. Such a trend is a consequence of a decrease in the frequency of insurance events, which is confirmed by the statistics of the traffic police, is explained in the review.

In general, the system of limits of insurance compensation in OSAGO "needs to be revised, since it does not fully compensate for the damage from the consequences of an accident," NKR experts emphasize. Reinsurance pool for OSAGO created

On April 12, 2022, a law came into force on the creation of a reinsurance pool for OSAGO, on April 20 it is planned to launch the mechanism. This means that insurance companies that have become part of a professional association will be able to redistribute risks among themselves for highly unprofitable types of insurance (for example, taxis). Market experts and legislators are confident that this measure will increase the availability of OSAGO policies and allow insurers to reduce the financial burden, while continuing to fully fulfill their obligations to car owners even during the crisis.

For April 2022, there is an analogue of the reinsurance pool - the E-Guarantor system, with the help of which the insured can apply for an OSAGO policy if for some reason he failed to do this directly in the insurance company. However, this system has a number of restrictions, such as a relatively small number of insurance companies with which you can conclude an agreement through it, the inability to conclude OSAGO contracts for legal entities, etc. The reinsurance pool mechanism will get rid of all these restrictions.

First of all, the client will be able to issue an OSAGO policy directly from the insurance company and receive it in any desired form - electronic or paper. Since the risks are divided between all participants in the reinsurance pool, insurers will more actively conclude contracts with problem customers. In addition, the client can be sure that upon the occurrence of an insured event, the payment will be made in a timely manner and in full. Also, the creation of a pool will have a positive effect on the cost of policies.

To become a member of the reinsurance pool, companies will not need a separate reinsurance license, only an OSAGO license. This will significantly expand the number of companies participating in the pool, since a license for reinsurance activities requires a minimum authorized capital of 600 million rubles, which many companies on the market do not have. Thus, the policyholder will be able to choose from many companies the most suitable for himself, not limited to a narrow set of organizations, as is now happening in the E-Guarantor system.

The largest insurance companies under OSAGO

In July 2022, the Kommersant newspaper published an article in which it named the largest OSAGO companies in Russia. The market leader is RESO-Garantia, which in 2021 received insurance premiums in the amount of 40.33 billion rubles (+ 5% by 2020) and paid 24.1 billion rubles (+ 34%) to customers. AlfaStrakhovanie and Ingosstrakh also got into the top 3.

According to statistics from the Central Bank of Russia, fees for mandatory "auto citizens" in Russia in 2021 reached 225.5 billion rubles (+ 2.5% or 5.5 billion rubles compared to 2020). Total payments amounted to 143.6 billion rubles, which is 4.5% more (or 6.2 billion rubles of the indicator of one year ago. The number of concluded OSAGO contracts in 2021 increased to 39.9 million from 39.7 million a year earlier. In the market as a whole, OSAGO insurers paid 63.6% of fees for the same period (in 2020, the figure was 62.4%).

The largest insurance companies for OSAGO are named

The average premium on OSAGO in 2021 amounted to 5649 rubles (+ 1.8%), follows from the data of the Central Bank. The most expensive policy remained with Megaruss-D - 10,833 rubles. But the company has only 24 contracts concluded per year, so it has practically no effect on the OSAGO market.

Of the top 20, the most expensive average policies are with Renaissance Insurance (7420 rubles) and Tinkoff Insurance (7092 rubles).

Increase in OSAGO payments by 11%

Payments under the system of compulsory insurance of motor liability (OSAGO) for 2021 increased by 11% compared to 2020 and reached 150.88 billion rubles. Such data at the end of March 2022 were published by the Russian Union of Auto Insurers (RSA).

The average insurance premium that a motorist pays for the purchase of an OSAGO policy in 2021 remained at the level of the previous year - 5590 rubles. The number of concluded contracts increased by 2.3% - from 41.3 million in 2020 to 42.2 million a year later. The total amount of fees also increased by 4% - from 226.985 billion to 236.001 billion rubles.

OSAGO payments for 2021 increased by 11%

The number of declared insurance cases in 2021 increased by 12% - from 2.06 million to 2.3 million accidents. The number of settled insurance events increased by 17%, from 1.85 million to 2.16 million incidents.

RSA President Igor Yurgens, commenting on the results of 2021 in the OSAGO market, noted that this type of insurance is a socially responsible business, and statistics once again confirm this. Against the background of sharp fluctuations in the cost of auto parts, which were observed during the coronavirus (COVID-19) restrictions, and the growth of payments, the average price of the compulsory "auto citizen" policy remained unchanged. Insurers manage to maintain the cost of the policy at the same level and with geopolitical tensions, sanctions and noticeable price increases, said Jurgens, whose words are quoted by the RSA press service on March 29, 2022.

OSAGO did not rise in price due to the individual calculation of tariffs - the reform aggravated competition between insurers and they reduced tariffs for car owners who do not bring losses, the RSA explained. According to the results of the first half of 2021, the discount for accident-free driving received 3.3 million more drivers than a year earlier.[8]

Dagestan is the main center for fraud with OSAGO

As it became known in August 2021, Dagestan remains the main center for fraud with OSAGO, the Bank of Russia said. The rolling payout ratio was 171% (2.7 times higher than the all-Russian one). The average insurance payment remained at the level of 77.1 thousand rubles (13% higher than the all-Russian indicator).

Payments in Dagestan exceeded the fees of insurance premiums by 1.2 billion rubles - the largest in absolute terms negative financial balance for OSAGO among all subjects of Russia.

The high-risk zone includes 10 subjects of Russia, including six subjects of the North Caucasus Federal District. The total share of insurance premium fees classified as a high-risk zone amounted to 5.5% of the Russian OSAGO market, while the contribution of these constituent entities of Russia to insurance payments reaches 10.3%.

On August 24, 2020, a law on the personalization of OSAGO tariffs came into force. This happened a month after the launch of a new IT system for this type of insurance.

When calculating the base rates, insurers now have the right to take into account various risk factors that increase the likelihood of an insured event. For example, rates can be raised for drivers who regularly violate traffic rules, including those prosecuted for drunk driving.

Road cameras began to calculate drivers without insurance in Russia

The choice of Moscow as a place for primary testing of the system is not accidental. By the beginning of August 2019, more than 1.5 thousand cameras are operating in the Russian capital (they are in the introduction of the data center), they record about 50 million driveways of all cars ( 3 million vehicles) per day[11]

The launch of the OSAGO inspection system by road cameras is delayed due to technical problems

In addition, as the executive director of the RSA Evgeny Ufimtsev told the publication, drivers often do not bother informing insurers about the registration plates of cars. This happens, for example, when applying for a policy before registering a new car with the traffic police: the contract is concluded for a car that does not yet have a license plate, and upon receipt of numbers, drivers do not always report this to insurance companies.

Even if the bases can be combined, the launch of the system is fraught with risks for drivers, warns Grigory Shukhman, an expert on photo and video recording systems. We are talking, for example, about conscientious drivers who unknowingly bought a fake policy, they will face a fine.[12] 

2018: Moscow launches OSAGO inspection system with road cameras
