2024: Restore electronics chain sued 1.6 billion rubles of Energogarant after a fire in a warehouse in the Moscow region
On July 5, 2024, the Moscow Arbitration Court satisfied the class action of companies associated with the Restore chain of electronics stores: against the Energogarant insurance company in the amount of 1.6 billion rubles. The decision was made in connection with the fire at a warehouse in the Moscow region, which occurred in May 2022.
According to Vedomosti, the court decided to recover the specified amount from the insurance company in favor of the three plaintiffs. The main part of the payment - 1.56 billion rubles and 16.4 million rubles as interest - will be sent to Restor LLC. The companies "Inventory DLM" and "Premium Networks" will be paid 25 million and 29 million rubles, respectively.
Leonid Zubarev, senior partner of Seamless, representing the interests of Energogarant, said that the insurance company intends to challenge the court's decision. A spokesman for Inventive Retail Group, which includes electronics chain Restore:, declined to comment until after the lawsuit.
According to Dmitry Malyutov, chairman of the Kovalev, Malyutov and Partners MKA, in 2023 Energogarant acted as a defendant in more than 100 disputes, and the total amount of claims exceeded 2.5 billion rubles.
Ivan Rybakov, an adviser to MEF Legal, noted that property insurance programs in warehouses are a popular and popular product in the market, around which litigation often arises. In most cases, courts tend to protect the interests of property owners if insurers try to challenge payments by citing violation of fire safety rules or hidden warehouse defects.
Forward Legal lawyer Lyudmila Lukyanova believes that if the decision is valid in higher instances, the likelihood of its execution is quite high, given the size of the assets of the Energogaranta insurance company[1]
