Ex-head of the clinic "Medicine 24/7" arrested in the case of the death of a patient

On February 12, 2024, the Investigative Committee of Russia (TFR) indicted Oleg Serebryansky, former Director General of the Medicine 24/7 private Moscow clinic, as part of the case of the death of the patient. Medic 24 doctors received time frame for patient's death due to lack of equipment

On January 22, 2024, the Simonovsky District Court of Moscow issued a verdict in the criminal case of doctors of the capital's Medika 24 clinic (formerly Medicine 24/7), whose actions led to the death of the patient. The head of the anesthesiology department Ruslan Pavlov, as well as resuscitators Pavel Naumov and Andrei Zimin, were in the dock. 2022: Clinic closure

In early June 2022, the Ninth Arbitration Court of Appeal ruled to close the Medica 24 clinic (formerly Medicine 24/7) in Moscow after the patient's death due to the lack of the necessary medical equipment.

As Kommersant writes with reference to court documents, the woman entered Medicine 24/7 on July 4, 2019 in a private ambulance. There she was diagnosed with acute myocardial infarction, after which the patient stayed in a medical facility until 18:00 the next day. However, the doctors of Medicine 24/7 could not improve the patient's condition, and at the request of her relatives she was transferred to the City Clinical Hospital No. 1 named after N. I. Pirogov, where she died after stenting.

The court closed the clinic "Medica 24" after the death of the patient due to lack of medical equipment

The decision of the Moscow Arbitration Court directly stated that in order to provide the necessary medical services "a cardiology room and a cardiology department with a resuscitation and intensive care ward were not organized in the clinic, which indicates a violation of the procedure for providing medical care to patients with cardiovascular diseases."

On this fact, a criminal case was initiated under paragraph "a" of Part 2 of Art. 238 of the Criminal Code of the Russian Federation (the provision of services that do not meet the requirements of the safety of life and health of consumers, committed by a group of persons by prior conspiracy). Ruslan Pavlov, Pavel Naumov and Oleg Serebryansky became defendants .

Law enforcement agencies asked the court to elect Pavlova and Naumova a preventive measure in the form of house arrest, but the Basmanny Court of Moscow decided to send them to a pre-trial detention center. Serebryansky was arrested in absentia and put on the international wanted list, since he was not in Russia.

The territorial body of the Federal Service for Supervision of Healthcare (Roszdravnadzor) in Moscow and the Moscow Region applied to the court with a request to revoke the medical license from the clinic.[1]

2021

Payment of 50 million rubles for poor-quality treatment of television producer Vladimir Artsibashev

In December 2021, the Savelovsky District Court partially satisfied Angela Khachaturian's claim against the Medicine 24/7 clinic and recovered 50 million rubles of compensation in favor of her and other family members of producer and director Vladimir Artsibashev.

Artsibashev died in the clinic "Medicine 24/7" in 2019. His relatives believe that the treatment was untimely, and the cause of death was a medical error. The Artsibasheva sisters filed a lawsuit with the Savelovsky court in March 2020.

According to Angela Khachaturian, the death of Vladimir Artsibashev was beneficial to his manager Ekaterina Shakina and Alexander Kovshov, then deputy director of the clinic. In 2017, Artsibashev was diagnosed with Alzheimer's disease. He underwent an operation and was transferred to the Medicine 24/7 clinic, where he died suddenly, before rewriting the property to Shakina and Kovshova, said lawyer Roman Maksimovich.

According to the widow, it was improper treatment that led to the death of the filmmaker, and the documents for his signature were allegedly given to him in a state when he obviously could not be responsible for his actions.

Anna Mamonova, a lawyer at the Moscow Bar Association, who provides legal support to the Moscow clinic Medicine 24/7, called the amount of compensation "absolutely disproportionate and unfair."

The head physician of the Medicine 24/7 clinic Oleg Serebryansky is on the wanted list by mid-December 2021, he was arrested in absentia. The head of the intensive care unit Ruslan Pavlov and the anesthesiologist Pavel Naumov in the pre-trial detention center, they were charged with the death of another patient, 83-year-old Vera Voronina, with whose relatives they pulled hundreds of thousands of rubles while the woman died of a heart attack without any help.[2]

Payment of 2 million rubles to the patient for unnecessary surgery

In October 2021, the District Court of Engels in the Saratov Region issued a ruling according to which the Moscow clinic "Medicine 24/7" will have to pay the patient almost 2 million rubles for an unnecessary operation.

The plaintiff went to this clinic in 2018. The man was diagnosed with pancreatic cancer and, according to several medical organizations, the tumor was inoperable. Nevertheless, the patient's son found information about the Medicine 24/7 clinic and turned there for help.

Clinic "Medicine 24/7" will pay the patient 2 million rubles for unnecessary surgery

After consulting the oncologist, the patient was offered an operation. It was estimated at 1.5 million rubles, another 300 thousand rubles had to be spent on molecular genetic diagnostics. Having received the consent of the patient, the clinic could not carry out the operation as planned. After the intervention, the patient was given a conclusion that it was impossible to remove the tumor for reasons that had previously been voiced by specialists from other medical organizations. The cost of services provided and stay in the hospital exceeded 700 thousand rubles.

In 2021, the clinic received the attention of not only supervisory, but also investigative authorities. Representatives of the Investigative Committee conducted an inspection at the medical institution at the request of the patient's relatives. Later, the photo of the building "Medicine 24/7" of the Investigative Committee of the Russian Federation illustrated the message about the initiation of a criminal case under paragraph "c" of part 2 of article 238 of the Criminal Code of the Russian Federation (the provision of services that do not meet safety requirements, resulting in the death of a person by negligence). It was about the death of a woman in a state hospital after hospitalization from a private medical institution in Moscow.

In August 2021, the Ninth Arbitration Court of Appeal recognized the punishment in the form of administrative suspension for a period of 90 days of the Medicine 24/7 clinic. Earlier, by the decision of the Arbitration Court of the city of Moscow, this medical facility was brought to justice under Part 4 of Art. 14.1 of the Administrative Code of the Russian Federation (carrying out entrepreneurial activities with a gross violation of the requirements and conditions provided for by the license).[3]

Searches after allegations of inappropriate treatment

In early May 2021, the Investigative Committee (IC) reported searches at the Medicine 24/7 clinic after she was accused of providing inappropriate medical services.

According to the statement of the UK, in the medical center, together with the employees of Roszdravnadzor of the city of Moscow, an inspection was carried out, medical and other documentation of interest to the investigation was seized. As part of the audit, investigators said, a legal assessment will be given to the actions of management and employees of a private medical clinic.

Searches were carried out in the Moscow clinic "Medicine 24/7" after being accused of poor medical care

As Yulia Ivanova, senior assistant to the head of the Main Investigative Directorate of the Investigative Committee of the Russian Federation in Moscow, told RIAMO, a pre-investigation check was appointed after a man turned to law enforcement agencies and said that his wife was being held by force in a private clinic. The woman was hospitalized on April 15. According to the man, since then her health has deteriorated, the woman is not released from the clinic and at the same time she is limited to visits for close relatives.

Telegram channel Mash on May 4 , 2021 cited a different version of what happened. According to him, Roszdravnadzor received information that a patient with a stroke was taken for treatment. He was put in intensive care, although the clinic did not have a license for cardiology services . " TASS soon  wrote about this, citing a law enforcement source :

Violations were identified in the medical institution, including the use of unregistered drugs and the lack of a license for operations. According to the agency, the clinic will also be checked for fraudulent actions. The issue of suspending the clinic is being resolved.[4]
