2020: SAP forced to pay off on debts the "daughter" of the Mechel group migrating on 1C

SAP CIS sued collecting from the Chelyabinsk Metallurgical Plant (CMP) entering into the Mechel group, about 37.5 million rubles for the services rendered by it and also a penalty fee in the amount of 1.8 million rubles out. The relevant decision of Arbitration court of the city of Moscow was published in a card file of legal cases in September, 2020.

Follows from the document that else in 2006 between SAP CIS and ChMK the service agreement on support of the software of SAP was signed, and further to it supplementary agreements were signed. Services for which the vendor through court collected payment from plant belong to the period from January to June, 2019. The court established that these services were accepted by the customer, however were not paid.

During "progressive tense" of SAP CIS conducted negotiations on debt repayment which existence the plant recognized with ChMK, but it was not succeeded to achieve payment, and the Russian office of the German vendor was forced to suspend rendering services, said in the published document. And before appeal to the court of SAP CIS also sent a pre-judicial claim to the address ChMK, but requirements which are contained in it were not met.

The court solved, proceeding from the transfer documents submitted to case papers signed bilaterally that SAP CIS fulfilled the obligations and considered the fact of existence of debt confirmed. The court also considered the requirement of the company about collecting interest for using someone else's money reasonable.

In ChMK at the time of the publication of material could not comment what emergence of debt was connected with and whether it is going to appeal against the decision of Arbitration court of Moscow. And in SAP CIS traditionally refused to comment on judicial proceedings.

The German developer not for the first time sues from ChMK of payment for the rendered services out. So, in November of the 2019th the Arbitration court of Moscow made the decision on payment to vendor of 89.3 million rubles and the interest accrued on them in the amount of 8 million rubles for maintenance of software in ChMK in 2017-2018. The initial amount of claim requirements at the same time was 136.8 million rubles.

ChMK tried to dispute this solution, but the attempt was not crowned with success: the appellate instance left the claim without satisfaction.

Remarkable it is possible to call the fact that judicial proceedings of SAP CIS and ChMK took place against the background of migration of the last and some other the enterprises of Mechel with SAP ERP on solutions of 1C. At the end of November of the 2019th Valery Dyachenko, the Chief information officer Mechel, at a conference told TAdviser what products of 1C are implemented and showed target architecture of IT solutions (see in the block below). The beginning of migration was preceded by the conclusion in 2017 of the agreement on establishment of partnership in the field of informatization between Mechel and 1C for strategy implementation of import substitution of the foreign software in mining and metallurgical group.

Meanwhile, SAP products, apparently, too continue to be used actively in ChMK. So, in October the vacancy of the administrator of SAP at this enterprise to which duties planning, completing and licensing of a SAP landscape, maintenance and service of SAP systems and so forth belongs was open.

2019

Mechel Group changes with SAP to 1C

Speaking at the TAdviser SummIT conference on November 27, 2019, Valery Dyachenko, the Chief information officer Mechel, one of the largest metallurgical and mining companies in Russia, told about projects which in it are implemented. In structure of group there is a Mechel Infotech company which was created as IT department for implementation of own projects and creation of the unified corporate systems. She is a franchisee of 1C Company and underwent certification in the Ministry of Telecom and Mass Communications.

The mission of Mechel Infotech company consists in implementation of a single corporate system (CIS), its further centralized technical support, and its main objective - in reduction in cost of ownership due to synergy and unification.

Analysts should be where business therefore they are on our largest production sites. Technical support is distributed across Russia for its providing from 8 in the morning to 20 in the evening Moscow time, - Valery Dyachenko noted.

Until nobody refused SAP, probably, we will be the first, - the representative explained Mechel. – It is our target landscape. As you can see, it all in yellow colors of 1C that gives the chance to construct a common information space and to integrate systems among themselves due to architecture of products of 1C. Integration happens and is event: transaction remains and appears in the next system where it is necessary for process continuation. System implementation in itself is good, but only integration gives good effect.

In Mechel Group the "1C: Payroll and HR Management" system is already implemented. Passed 57 companies with the total number of staff about 47 thousand to this solution, and target indicators – 73 companies and 63 thousand employees. The project started with modest tasks, but during implementation went beyond their framework, and document flow became "bridge" between all systems in ERP.

For document flow we created "show-window": that those employees who have no computer in a workplace, had an opportunity to be connected to services of corporation and an opportunity, for example: look at the pay slip and vacation days, to order the 2-PIT statement, - Valery Dyachenko told. – In such type a system already works, but we will increase functionality further that employees could leave from mobile devices, from the home computer. At the same time personal data protection in a system is provided.

  As of the end of November during implementation there was implementation of the following systems:  

  • "1C:ERP", target reference points: 6 industrial enterprises, 7 thousand users, consecutive integration with the historical systems, a failsafe flexible server architecture with the redistributed loading;

  • "1C: Document Flow": personnel document flow, "supporting documents", YuZDO, failure from paper carriers, personal accounts of users with a connectivity of personal mobile devices;

  • "1C: Holding Management": integration with the system of Client-bank, other systems, currency exchange control, etc.;

  • Implementation of program robots for the purpose of decrease in volume of routine transactions.

Systems should be integrated among themselves seamlessly, Valery Dyachenko emphasized, data exchange should take place without human participation. The main task - to make CIS a single, monolithic system within which the majority of processes is automated.

  Answering a question of conferees of advantages of 1C in comparison with SAP, the speaker selected more operational, according to it, support of changes in the Russian legislation. In a case with 1C they very quickly are reflected in a system.

And earlier in 2019 Vadim Dyachenko, in addition, from advantages of 1C brought the price of products into an interview of CNews. Then he as one of the reasons of migration called the fact that the system of SAP used at a number of the Mechel enterprises in 2025 will be removed by vendor from support. Therefore it was necessary to make the decision — or migration on SAP S/4HANA that would leave expensively, or transition to the Russian product[1].

In 2019 one of the enterprises of Mechel - the Chelyabinsk Metallurgical Plant (CMP) migrating from the ERP system of SAP on 1C lost in court in the claim of the German vendor for debt collection for support of its software on which SAP accrued interest in 8 million rubles. In total the court obliged to list ChMK to the foreign developer of 97.3 million rubles[2].

TAdviser SummIT took place in Moscow on November 27, 2019 and attracted more than 700 participants - heads and experts of IT departments of the largest companies and the state departments of Russia, representatives of IT developer and contractors. During the action the prospects of digital transformation of business and state agencies, development of technologies, products and services were discussed. The conference took place with assistance of the Ministry of digital development. The head of department Konstantin Noskov who during the open discussion summed up the first results of the Digital Economy national program participated in it. In total in a plenary part and five thematic sections about 60 reports were heard. The action took place in 5 Radisson Blu Olympiyskiy halls.

Rostec will create the systems of intellectual electricity metering and diagnostics of the equipment for Mechel

The Avtomatika concern Rostec Group will be engaged in implementation of the systems of intellectual electricity metering, development of control systems and diagnostics of the equipment and also improvement of telecommunications of Mechel Energo entering into the mining and metallurgical Mechel group. The relevant agreement was signed in December.

Rostec will create a number of the unique digital systems for Mechel. In particular, the automated complex for remote control and diagnostics of a status of the power equipment – boilers, turbines, turbine generators, electric motors, elements of high-voltage substations. Besides, creation of a system of collecting and data processing from power plants is planned. In the long term for management of all power complex of the Mechel group the situational analytical center will be created.

Among the developments which are proposed to implement on objects of Mechel, also modern devices and the systems of intellectual electricity metering on domestic microelectronic base. The new equipment will allow to trace online an electric power expense at the enterprises, to optimize energy consumption and to quickly eliminate failures.

"The digital electrician" will become one more significant project of Rostec for the benefit of Mechel: the mobile application intended for automation of activity of the personnel performing works on maintenance and repair. It will allow to plan tasks, to order transport and special equipment, to control performance of work and another.

2017: The conclusion of the partnership agreement with 1C

Mechel and 1C signed the agreement on establishment of partnership in the field of informatization for strategy implementation of import substitution of the foreign software in Mechel. The companies calculate that the new level of strategic partnership will allow to increase quality of process automation of financial and economic activity of the enterprises of Mechel using solutions based on the Russian software of 1C and will promote substitution of the information systems implemented based on the foreign software.

Within strategy implementation of import substitution in Mechel the 1C:Enterprise 8 platform was selected. At the time of agreement signature in Mechel the project on transfer of the enterprises on a single system of accounting and tax accounting was already executed. Less than in one year more than 30 companies of group are transferred to this system.

The project supposes creation of single industry solutions for each division of Mechel based on large enterprises, such as Southern Kuzbass and Chelyabinsk Metallurgical Plant to unify and automate industry processes of production, managerial and regulated accounting.

2011: Strategic partnership with SAP

In September, 2011 announced Mechel signing of the memorandum of strategic partnership with SAP company. The document provides step-by-step deployment of the SAP solutions based on specialized industry packets in the mining, metallurgical and sales directions of business of Mechel.

At a meeting the decision on joint project implementation of ERP on all business units of sales network of the company is also made. ERP was going to be implemented in complete functional volume for sales divisions within 18 months.

The implementation project of a system of consolidation Mechel on the SAP platform began in 2007 and covered all divisions of the company. It allowed to optimize a number of important processes in finance and to standardize process of collecting and preparation of consolidated financial statements of holding.
