Development of amendments to traffic rules that equate an electronic driver's license with a paper one

In mid-July 2023, the Ministry of Digital Science published amendments to the traffic rules, equating an electronic driver's license with a paper one. According to the document, "information" from driver's licenses, STS and other documents that should be with them by the person driving the vehicle can be presented to the inspector "in electronic form" - using the mobile application Public services.Avto. "

According to the authors of the innovation, it is aimed at simplifying the procedure for confirming the right to drive a vehicle, as well as digitalizing relations related to road safety. It is also noted that the adoption of the draft resolution will not require additional funding from the federal budget. Interviewed Businessman"" experts supported the idea of equating electronic driver's licenses with paper ones.

An absolutely correct initiative, this has already been tested on the example of electronic OSAGO policies, "says Sergey Radko, lawyer for the Freedom of Choice movement. - Technically, it is quite possible to replace the paper documents we are used to with electronic information. This will allow drivers not to worry about the lack of the necessary documents and the associated unpleasant consequences. Moreover, the driver's lack of these documents is not directly related to traffic safety.

The coordinator of the Blue Buckets movement, Pyotr Shkumatov, noted that emergency situations are also possible on the road - for example, a phone battery suddenly sat down or the screen broke. In this case, as the expert noted, if the driver does not have paper originals with him, de jure he finds himself without documents at all, which means he can be prosecuted under Art. 12.3 of the Administrative Code - a fine of 500 rubles.

According to him, in 2022, an experimental operation of an electronic service was carried out to present a certificate of registration of a vehicle using the application Public services.Avto. " In the first week alone, the application was downloaded more than 1 million times. The experiment received positive reviews from motorists, Chernikov emphasized.

He said that by September 21, 2022, amendments to the traffic rules are being prepared so that electronic driver's licenses are considered a fully legal document. Moreover, the traffic police plans to make the project available throughout the country, as well as establish its work offline so that drivers can show their rights in places where they do not catch the Internet, said the head of the State Traffic Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation.

In early June 2022, the Ministry of Internal Affairs and the Ministry of Digital Science spoke about the development of a new portal for online verification of driver's licenses. Digital rights hacked in Australia

In late May 2022, the government of the Australian state of New South Wales, which advertised its digital driving licences as unsuitable, found they were just as easy to forge.

Introduced into general circulation in 2019, the driver's license allowed users to use their own mobile phone for confirmation of identity and age during police checks on the roads or in bars, shops, hotels and other places. System developers from ServiceNSW promised the technology data would provide an additional layer of security and protection against personal fraud compared to the plastic driving licence Australian citizens used.

In Australia, "unbreakable" digital rights hacked in an hour

In 2022, security researchers showed that virtually any user could fake a digital driver's license by creating a fake identity. According to Fudzilla, this method was actively used by people under the age when they can drink, they simply changed their date of birth, and some financial fraudsters forged fake certificates and other documents from banks. The process takes no more than an hour and does not require special hardware or expensive software, and also allows the generation of fake IDs that are verified using an electronic verification system used by police and participating Australian government agencies.

Information security researcher Noah Farmer, who identified the flaws, wrote in his report that the digital driver's license did not have a more robust design and did not provide additional layers of security. Farmer added that he believed the Australian government had simply decided that if it said it was unbreakable technology, then people would believe them.[2]

Putin instructed to conduct an experiment with digital copies of passports and driver's licenses

On February 15, 2021, the Kremlin website published an order from Russian President Vladimir Putin on the need for an experiment to use digital copies of documents. Read more here.

Clarification of the format of the experiment on the use of digital driver's licenses

On January 26, 2021, the Ministry of Internal Affairs of Russia made explanations of the format of the experiment on the introduction of digital driver's licenses.

File:Aquote1.png
Currently, together with the Ministry of Digital Science of Russia, in order to increase the convenience of drivers, a joint study is underway on the possibility of duplicating documents issued on paper in electronic form, - said the official representative of the Ministry of Internal Affairs Irina Volk.
File:Aquote2.png

According to her, if the experiment is successful, the Ministry of Emergency Situations will consider the transfer to the electronic form of driver's licenses.

It is explained that electronic documents will be sewn into the QR code, which drivers will need to present at the request of police officers. A police officer using a portable device will be able to read two-dimensional barcodes and view data on the driver and his car on the screen if they are in the database.

The Ministry of Internal Affairs of the Russian Federation explained the format of the experiment with digital driver's license - drivers should have paper documents with them

The list of documents provided to the police officer at his request, according to paragraph 2.1.1 of the Traffic Rules of the Russian Federation, includes a driver's license and registration documents for the vehicle. The Ministry of Internal Affairs emphasizes that driving vehicles without documents provided for by the traffic rules of the Russian Federation, as well as any other changes in the legal regime in the regions, is not planned for the period of experimental operation of the services and mobile applications created. The presentation of electronic copies of documents instead of their originals in pilot regions is not provided, Volk said.

By the end of January 2021, the Ministry of Internal Affairs is considering a project to use an electronic vehicle registration certificate. In relation to driver's licenses, such a question will be considered only in case of successful experience in using a digital STS, concluded Irina Volk.[3]

Start of creating digital driver's documents in the Russian Federation

In mid-2021, it became known about the beginning of the creation of digital driver's documents in Russia. The Ministry of Digital Industry is preparing to launch an experiment to use a mobile application with a QR code instead of a driver's license and a vehicle certificate (STS).

File:Aquote1.png
The inspector could read the QR code and get the information. If you forget the right at home, you sit and do not shake, because the phone is always with you, you will definitely not forget it, - explained the deputy head of the Ministry of Digital Science Oleg Kachanov during the Gaidar Forum.

Creation of digital driver's documents begins in Russia

According to Kommersant, the Ministry of Internal Affairs insists that the inspector see on the phone in the application of public services a large, high-quality photo of documents, and the QR code can be an addition to verify the authenticity of the image. Paper driver's licenses are mandatory under the Vienna Convention on Road Traffic, the source of the publication in the Ministry of Internal Affairs draws attention, but the STS can be refused. But a number of aspects of the digitalization of driver's documents have not yet been resolved: for example, the driver took out a phone with a photo of his license in the cold, and the gadget suddenly turned off, the source said.

The project can be implemented in four "most digital" regions of the country. Which ones are not specified. However, in July last year, the regions were named - the leaders of digitalization of the first half of 2020. In the top 5 then were Moscow, the Moscow region, the Republic of Tatarstan, the Krasnodar Territory and the Novosibirsk region.

Yaroslav Nilov, Chairman of the Committee on Labor, Social Policy and Veterans Affairs, supported the initiative to introduce electronic driver's licenses.

There is no need to carry additional documents with you when modern technologies allow you to quickly understand whether the driver has the right to drive a vehicle or not, "he said.[4]
