In mid-October 2021, the Cheremushkinsky court of Moscow recovered almost 4.3 million rubles from the state in the person of the Ministry of Finance in favor of hematologist Elena Misyurina, who was accused in a criminal case due to the death of a patient. Property damage caused by criminal prosecution is estimated at this amount.

The case of a hematologist, which provoked a wide public outcry, was initiated after an emergency in a private clinic "Genotechnology" on Profsoyuznaya Street To Moscow in July 2013. Misyurina was initially found guilty of violating the procedure during a bone biopsy. brain The investigation stated that the doctor pierced a male patient's blood vessel with a needle, which caused death.

The Cheremushkinsky court sentenced Misyurina to two years in a penal colony, finding her guilty of committing a crime under paragraph "c" of part 2 of Art. 238 of the Criminal Code (the provision of services that do not meet the requirements of safety of life or health of consumers, resulting in negligence causing grievous bodily harm or death of a person).

The verdict caused a wide public outcry - many representatives of the medical community spoke out in support of the convict. The public organization "League for the Protection of Doctors" organized a petition demanding a review of the case. Leonid Roshal, president of the Research Institute of Emergency Pediatric Surgery and Traumatology, called the verdict "lawlessness."

Later, the Moscow City Court canceled the sentence and returned the case to the prosecutor's office, the doctor was released on his own recognizance. On December 16, 2020, the Second Court of Cassation of General Jurisdiction overturned the decision of the Moscow City Court.

In March 2021, the Moscow City Court again overturned the sentence. The criminal case against Misyurina was dismissed for lack of corpus delicti. The Prosecutor General's Office of the Russian Federation noted that violations were committed during the investigation, and the collected and investigated evidence did not allow to draw an unequivocal conclusion about the proof of guilt of the hematologist.[1]
