Oleg Osipov, chief engineer of Beshtau Electronics, notes that ambiguities in public procurement legislation allow customers to establish overly detailed requirements that can only be suitable for certain manufacturers.

On November 15, 2024, the Aititiji company sent a complaint to the FAS, pointing out violations in the terms of reference and the rules for using the catalog of goods for state needs. According to the Kontur. Focus service, the company has participated in more than 70 public procurement since 2020.

The applicant believes that the FSSP violated the law by applying OKPD2 codes instead of mandatory items from the catalog of goods and services. This can affect the transparency of the procurement process.

The terms of reference specify three types of servers with different technical characteristics. According to the government decree of February 8, 2017, the customer can indicate additional characteristics if they are not provided for in the catalog.

After filing a complaint, the determination of the supplier should have been suspended, but the FSSP chose the winner. The name of the supplying company has not yet been disclosed.

The FAS will have to consider the validity of the complaint and decide on a possible suspension of the purchase or issuing an order to eliminate violations.[1]
