2025: Cartel collusion in the procurement of medical devices

On June 3, 2025, the Federal Antimonopoly Service of Russia (FAS) announced the identification of a cartel conspiracy in the procurement of medical devices with a total value of more than 620 million rubles. The corresponding tenders were held for the needs of state institutions in St. Petersburg and the Kaliningrad region.

According to the ministry, Alma-Med LLC and Makrus LLC participated in the conspiracy. The FAS found that these companies used a single infrastructure to participate in the auction. In addition, they have a stable financial, economic and economic relationship. Government contracts were concluded without reduction or with a minimum reduction in the initial maximum price.

FAS revealed the cartel in the supply of medical products for 620 million rubles

Alma-Med and Makrus were convicted of violating antimonopoly laws in accordance with paragraph 2 of Part 1 of Article 11 of the Federal Law of 26.07.2006 135-FZ "On Protection of Competition" (a ban on economic entities restricting competition). The total volume of initial maximum contract prices amounted to 621 063 371 rubles.

Cartel participants face fines in accordance with Part 2 of Art. 14.32 of the Code of Administrative Offenses of the Russian Federation - conclusion of a competition-limiting agreement, implementation of coordinated actions restricting competition, coordination of economic activities. The amount of penalties for such violations can be from 20 thousand to 50 thousand rubles for officials, from one tenth to one second of the initial cost of the subject of the auction for legal entities, but not more than one twenty-fifth of the total amount of the offender's proceeds from the sale of all goods (works, services) and at least 100 thousand rubles.

The FAS reports that the materials collected during the antimonopoly investigation will be transferred to law enforcement agencies to resolve the issue of initiating a criminal case.[1]

2024: Cartel collusion with Macrus LLC

Federal Antimonopoly Service Russia discovered a cartel conspiracy between Alma-Med LLC and LLC Macrus"" in the supply of medical devices for state institutions in three regions. This became known on December 11, 2024. The total amount of initial maximum contract prices amounted to ₽681,7 million.

According to the press service of the Federal Antimonopoly Service of Russia, violations were revealed at the auction for state institutions of St. Petersburg, the Kaliningrad region and the Republic of Dagestan. A case of violation of antitrust laws has been initiated against the companies.

The antimonopoly agency found that the companies refused to compete and systematically used a unified model of behavior when participating in electronic auctions. The actions of the organizations are qualified as a conspiracy to maintain trading prices.

The violation falls under paragraph 2 of part 1 of article 11 of the Federal Law "On Protection of Competition." If guilt is confirmed, companies face negotiable fines in accordance with Part 2 of Article 14.32 of the Code of Administrative Offenses of Russia.

The Federal Antimonopoly Service continues to actively work to identify and suppress cartel collusion at tenders in the field. health care Particular attention is paid to the procurement of medical equipment and supplies for public medical institutions.

The case materials will be considered in accordance with the procedure established by law. After the investigation is completed, the Federal Antimonopoly Service of Russia will decide on the application of administrative responsibility measures to the participants in the cartel agreement.[2]
