2022: Ozon joins code of ethics on data use

2020: Joining the CleverDATA Code, SberLeasing, SberMarket and Avito

On October 13, 2020, ABD announced a meeting of the Council for Improving Data Practices. During the meeting, it was decided to join the Code of four companies: CleverDATA, SberLeasing, SberMarket and Avito. They are also included in the Register of Bona fide Data Market Participants alongside the other signatories.

Joining a large number of participants to the Code of Ethics for the Use of Data allows us to develop the document and its principles, as well as enrich the White Paper, taking into account the expertise of companies from various fields of activity. By the decision of the council, CleverDATA, a technology provider that helps companies work with data for marketing and advertising purposes, joined the Code of Ethics. CleverDATA configures the interaction of companies in terms of data exchange. Among other things, it conducts educational activities together with MGIMO, the Russian State Humanitarian University and the Higher School of Economics in terms of working with data.

SberLeasing, which is a diversified leasing company, also joined the Code of Ethics. The company works with open data on leasing transactions and conducts 100 thousand transactions per year. It works with two types of data - data on payment discipline, which are used for forecasting models, as well as publicly available data, on the basis of which forecasts are made about the likelihood of leasing transactions in the market. He works with the Ministry of Transport of the Russian Federation and the Ministry of Economic Development of the Russian Federation in terms of developing programs to support the transport industry. The company has expressed a strong desire to join the Data Code of Ethics to gain experience in data practices and ethics.

Avito, an online ad service in Russia, was the last to join the Code of Ethics. In 2019, Avito users made transactions worth 1.7 trillion rubles. These included 116 million transactions for the sale of goods, which the audience of the Internet service carried out among themselves (this is 66% of all C2C transactions in Runet). In addition to these signatories to the Code, the Council approved additional good practices for inclusion in the White Paper. The experts recognized the need to depersonalize personal data when working with testing systems as the first recommended practice of fair handling of data. Each company, when installing software or updating an old one, is faced with testing it. It is recommended to check systems based on impersonal data in order to protect personal data of consumers. It is also recommended to use the depersonalization of personal data in regulatory sandboxes within the framework of experimental legal regimes for testing hypotheses, algorithms and services. Depersonalization of personal data helps to increase the level of protection of personal information of customers and allows you to check the quality of systems safely.

Another positive practice was recognized as the mechanism for the user to refuse marketing communications that the marketing intermediary implements. Often companies resort to the services of marketing intermediaries, as a result, the consumer receives advertising through several channels at once, and in accordance with Russian law, the consumer can refuse to receive such messages at any time. If the customer withdraws his consent to receive marketing messages in one company, the company is obliged to ensure that advertising messages are stopped and information about the refusal is transmitted to its marketing intermediaries. So companies ensure the right of the client to completely abandon advertising messages of his company and protect user data from being used for marketing purposes against their wishes.

Create a board to improve data practices

The Board for Improving Data Practices, created to properly implement the code of ethics for the use of data, in particular, will deal with incidents that indicate its violation by participants. Moreover, the council will accept complaints about non-compliance with the rules of the code by participants, as well as exclude malicious violators from the relevant register, which will entail serious reputational costs for them. This was announced in December 2019 by TAdviser, head of the Analytical Center under the Government of the Russian Federation, Vladimir Onishchenko.

The unethical use of data, according to the developers of the code, is excessive targeted advertising and abuse of user data, Onishchenko noted.

The coordinating center of the council for improving data practices, as stated at the Institute for Internet Development (IRI) on the signing of the code, will be the analytical center of the government of the Russian Federation. In addition to him, the council will also include representatives of other government organizations. The Council, as stated by the head of the Big Data Association Anna Serebryanikova, was created for daily work by the code participants to improve regulation and develop new approaches to technological initiatives. Signing the code

Continuous maintenance and updating of the White Paper will contribute to the implementation of best business practices in the field of data use.

The objectives of the Data Code of Ethics are:

  • Consolidate the basic principles of interaction between interested parties - the state, citizens, business;
  • Formulate universal rules that define the boundaries of acceptable behavior for the entire professional community;
  • Create a database for subsequent data regulatory initiatives.

The Code of Ethics for the Use of Data will be open to new participants who are ready to join and support the declared principles and norms. A section dedicated to the Code of Ethics will appear on the website of the Analytical Center under the Government of the Russian Federation, and an up-to-date version of the document will be posted there. It will also be possible to find information on the procedure for joining, find the current composition of the council for improving data practices and the register of code participants.

The purpose of this registry, as TAdviser indicated in the IRI, is to inform all those who are interested in the code about the composition of its participants. First of all, according to Anna Serebrennikova, those companies that have already supported the code will be included in the register.

But we will consider applications from anyone who wants to join the initiative and show their bona fide attitude towards the data market and its participants. For business, good faith is not empty words. The biggest players who initiated the work to create the Code, it is important that their customers, the people these companies work for, trust those who provide them with services and sell goods.
