2024: Penalty for data leakage of Kazakhstanis

On May 6, 2024, the Ministry of Digital Development, Innovation and Aerospace Industry of the Republic of Kazakhstan reported that Kazakhtelecom and Air Astana were fined for leaking personal data of citizens. The total amount of recovery amounted to 369,200 tenge, or 76,900 rubles at the exchange rate as of the specified date. Companies were issued prescriptions for a period of one year.

It is said that on February 16, 2024, cybercriminals posted on the GitHub resource "leaking data from a Chinese company," which also contained personal information from Kazakhstanis. The Ministry of Digital Development, together with the National Security Committee of Kazakhstan and the State Technical Service (GTS), conducted unscheduled inspections in relation to Kazakhtelecom JSC and Air Astana JSC, as a result of which these legal entities were brought to administrative responsibility in connection with violation of information security requirements.

It is noted that the Ministry of Digital Development of the republic pays special attention to the protection of personal data of citizens. In particular, a leak was recorded at the University of KazNU named after Al-Farabi. It was established that an employee of a medical organization that acts on the basis of a contract with a university, on February 6, 2024, through Whatsapp, sent documents in Excel format with a list of students to undergo fluorographic research. This document, in addition to the full name of the students, contained information related to medical secrecy.

And on March 5, 2024, the GTS discovered a leak of "more than 2 million personal data of citizens" who are clients of MFO zaimer.kz (MFO Robokesh.kz LLP). According to the results of an unscheduled audit, an administrative fine was imposed on the organization in the amount of 500 MCI (monthly calculated indicator), or 1,846,000 tenge (about 384.5 thousand rubles[1]
