History

2024: Recovery of 432 million rubles at the suit of the Russian division of Google

On July 31, 2024, the Moscow Arbitration Court satisfied the claim of Google LLC, the Russian division of Google, declared bankrupt, and recovered more than ₽432 million from the advertising agency Artix IS LLC. The dispute arose under the agreement on the provision of advertising services dated August 15, 2019.

According to the Prime agency, initially in April Google demanded to recover about ₽1,8 billion from the defendant. In June 2024, the court took interim measures, arresting this amount in the accounts of Artix IS. After that, the defendant paid the plaintiff about ₽1,4 billion of principal debt. In the remaining part - in the amount of about ₽441 million, including more than ₽152 million principal debt and more than ₽288 million penalties - the defendant did not recognize the claim and contributed this amount as counter security to the court deposit.

Google Russia sued 432 million rubles from the advertising agency Artix IS

At the meeting, the defendant stated that he fully recognizes the main debt and does not agree only with the calculation of the penalty. According to him, a Google employee asked him temporarily not to pay for services in 2022 due to uncertainty with the accounts of Google's subsidiary in Citibank. The court reduced the penalty and recovered from Artix IS LLC more than ₽152 million of the principal debt and ₽280 million of the penalty.

This is not Google's only case against counterparties on advertising contracts. Earlier in 2024, the Moscow Arbitration Court recovered about ₽1,5 billion in a lawsuit filed by Google against Emdzhikom LLC, which owns the large advertising agency MGCom. At the end of July 2024, several more major Google lawsuits against counterparties are being considered.

The Moscow Arbitration Court declared Google LLC bankrupt and opened bankruptcy proceedings in the company. According to the bankruptcy trustee, as of April 2024, the register of claims of Google subsidiary creditors included claims of 1,145 creditors worth more than ₽23,2 billion.[1]
