2020: A penalty in the amount of 150 thousand rubles for gross violations in treatment after which the patient died

At the end of October, 2020 the Nizhny Novgorod district court made the decision on collecting 150 thousand rubles from the Balakhna central district hospital in which because of gross violations the patient died in treatment.

According to the joint press service of courts of law of the Nizhny Novgorod Region, on July 19, 2018 in hospital of Balakhna hospitalized the man with intense violation of brain blood circulation. In abuse of regulations of delivery of health care it was placed in intensive care unit not at once, did not execute complete inspection and did not appoint necessary medicines.

Besides, before purpose of anti-coagulates risk assessment of thromboses and bleedings is not carried out. The research of content of oxygen and a carbon dioxide gas in blood at deterioration in a status of the patient was not conducted. As a result the man died on August 1, 2018. Death came from brain hypostasis owing to intense violation of brain blood circulation on ischemic type in the pool of the left average brain artery.

The brother of the died man with the claim to the Ministry of Finance of the Russian Federation, the Russian Ministry of Health, the Ministry of Health of the Nizhny Novgorod Region and the Balakhna central district hospital took legal action. Representatives of defendants did not recognize claim requirements.

The court made the decision which it collected from the Balakhna central district hospital for benefit of the brother of the dead compensation of moral harm in the amount of 150 thousand rubles. The claimant demanded 1 million rubles. The appointed compensation was significantly lower as cause and effect relationship between defects of delivery of health care and the death of the patient was not set so claims are satisfied partially.

Besides, for gross violations of license requirements the deputy chief physician was brought to the administrative responsibility and fined 20 thousand rubles, said in court's decision.^[1]
