2023: Payment to the doctor of 400 thousand rubles for falling on a slippery floor
On June 29, 2023, the Oktyabrsky District Court of Izhevsk (Udmurtia) ordered the city clinical hospital No. 6 (BUZ UR "GKB No. 6 MZ UR") to pay compensation for moral damage and treatment costs to a doctor injured at the workplace. The total amount amounted to almost 400 thousand rubles.
Since April 2021, the plaintiff has worked in the department for the treatment of patients with a new coronavirus (| [[Coronavirus COVID-19 COVID-19) infection in the hospital complex as a general practitioner. The incident occurred in September 2021. It was established that in the line of duty, the woman slipped on the wet floor and fell, having received a serious injury. It is said that this entailed serious harm to health and disability for the period from September 2021 to December of the same year. In other words, the victim could not work for about four months.
In connection with the plaintiff's injury, the defendant conducted an investigation into an accident at work, as a result of which an act was drawn up according to which the cause of the accident was the personal negligence of the plaintiff who violated the requirements for labor protection, as well as the plaintiff's non-use of special shoes, the case file says. |
The doctor in her statement asked the court to invalidate certain clauses of the industrial accident act, to recover from the defendant compensation for moral damage in the amount of 500,000 rubles, as well as treatment costs in the amount of 86,200 rubles.
Having considered the arguments of the parties, the court sided with the victim: the act was declared invalid. At the same time, the amount of payments turned out to be lower than the one requested by the doctor. In particular, the court recovered in favor of the plaintiff compensation for moral damage in the amount of 350,000 rubles and treatment costs in the amount of 24,433 rubles. The decision entered into legal force.[1]
