2022: The court ordered to return 7 million rubles to the Krasnodar Ministry of Health due to the supply of unregistered catalogs

In April 2022, the Arbitration Court of the North Caucasus District ordered the return of 7 million rubles to the Krasnodar Ministry of Health due to the supply of unregistered catalogs. We are talking about the contract that the department concluded with the company "Diacoms" in 2018.

In 2019, it was executed and the customer paid the supplier. According to the results of the verification of the legality and effectiveness of procurement costs, which was carried out by the regional Chamber of Control and Accounts, the Ministry of Health was recommended to check their registration.

The territorial body of Roszdravnadzor issued a negative opinion: the registration certificate provided with the trolleys does not apply to them. The delivered medical product is not registered in accordance with the current legislation. The supplier was sent a claim, and when there was no response to it, the ministry appealed to the court.

During the court hearing, it turned out that representatives of the Chamber of Control and Accounts drew attention to the fact that the trolleys delivered to the Ministry of Health differed from those published in the supplier's catalog and which were subject to a registration certificate. The discrepancy was confirmed during the examination of Roszdravnadzor.

The court satisfied the requirements of the Ministry of Health of the Krasnodar Territory. Then Diacoms filed a cassation appeal, which, as a result, the Arbitration Court of the North Caucasus District dismissed.

The court of cassation has no grounds for disagreeing with the conclusions of the courts of first and appellate instance. The company in the cassation appeal did not present arguments refuting the circumstances established by the courts, the decision of the Arbitration Court of the North Caucasus District says. It entered into force in April 2022.[1]
