History
2022: Introduction of arbitration surveillance
On April 5, 2022, it became known that in relation to the main asset of the Compulink IT group, Infralink LLC (until April 2020, USP Compulink LLC), the so-called surveillance was introduced by court decision. This follows from the record in the trial card in the Moscow Arbitration Court, which on July 9, 2021, LLC C2 Electrician filed a lawsuit.
As the interim manager of Infralink, on March 28, 2022, Valery Makarov, a member of the Self-Regulatory Organization of Arbitration Managers of the Central Federal District (PAU Central Federal District), was approved. In the next six months, he will analyze the financial condition of the debtor in order to determine possible ways out of the crisis for him. He will have to familiarize the court with the results of his work on September 28, 2022.
Observation is called one of the procedures for declaring the organization insolvent - bankrupt. The surveillance procedure is not irreversible - creditors, together with the owners, may still try to save the company.
The law provides for various ways of paying off debts to creditors. If no positive solutions can be found, then the bankruptcy procedure will enter the irreversible stage of bankruptcy proceedings. Then the debtor will be declared bankrupt finally, and the activities of the bankruptcy trustee will be aimed at finding and selling the company's property.
According to court documents, the bankrupt Infralink LLC C2 Electrician went to court with claims of a debt nature for 7.87 million rubles. After the introduction of the surveillance procedure, the court began to include other companies on their applications in the register of claims of creditors. In particular, Tilsit House LLC filed claims for 5.4 million rubles, and Mosoblgaz JSC - for 16.2 million rubles[1].
2020
Rename to "Infralink"
In April 2020, USP Compulink LLC was renamed Infralink LLC.
After renaming USP Compulink to Infralink as part of Compulink Group of Companies in early 2020, the company changed its profile from a system integrator to a multidisciplinary construction company, which, according to the organization's website, provides design, construction and installation, reconstruction, re-equipment, energy service and supply services (EPC contracts).
Compulink declared an "unscrupulous supplier" because of an amazing project
As it became known to CNews in March 2020, the large Russian system integrator USP Compulink (part of the Compulink group) is included in the register of unscrupulous suppliers (RNP) as[2] the federal law "On the contract system in the field of procurement of goods, works, services to meet state and municipal needs" (44-FZ)[3].
According to the information published on the public procurement portal, the integrator was entered in the register by the FAS Office for the Republic of Crimea and the city of Sevastopol on March 3, 2020. The reason for making such a decision was the termination of the company's agreement with the State Unitary Enterprise of the Republic of Kazakhstan "Water of Crimea" on the initiative of the latter. USP Compulink allegedly could not complete the work provided for by the contract in the amount of about 92 million rubles on time.
Inclusion in the RNP imposes restrictions on the company to participate in tenders for 44-FZ, which describes the procurement rules for state and municipal needs.
However, USP Compulink still has the opportunity to participate in tenders for 223-FZ, which regulates the procedure for purchases by state-owned companies (legal entities that belong to the state by more than 50%), unless there is a condition for the absence of a supplier in this register in the customer's requirements.
The integrator concluded a multimillion-dollar contract with Water of Crimea in September 2017. Under its conditions, it was necessary to carry out a number of construction and installation works in three months (until December 25, 2017) as part of the reconstruction of decontamination systems at water treatment facilities (BOS) of Feodosia. According to the technical assignment, the project provided for "the construction of buildings performed in a frame-connected frame in the transverse direction single-span frames, in the longitudinal vertical cross ties" (spelling and punctuation are preserved. - approx. CNews).
The signing of the contract was preceded by an electronic auction mandatory in such cases, under the terms of which the initial contract price was 116 million rubles. Among its five participants, the commission selected three: Regionspetsstroy, USP Compulink and the Company for the Adjustment, Improvement of Technology and Operation of Power Plants and ORGRES Networks. The latter was declared the winner, since it offered the smallest amount of the contract - a little more than 92.2 million rubles. However, the agreement with ORGRES, as follows from the entries on the public procurement portal, was never concluded, so it went to the auction participant with the second best offer, that is, USP Compulink.
