Seizure of $439.5 million and JP Morgan assets in VTB lawsuit
In April 2024, the Arbitration Court of St. Petersburg and the Leningrad Region arrested $439.5 million and the assets of JP Morgan in Russia at the suit of VTB. This is evidenced by the materials in the file of arbitration cases.
On April 17, 2024, VTB 17 filed a lawsuit against nine structures of JP Morgan Chase & Co., including the Russian subsidiary, JP Morgan Bank International. At the same time, the Russian bank sent a petition to secure the application. In response, on April 18, JP Morgan Chase filed a lawsuit against VTB in a New York court demanding to stop attempts to return $439.5 million. In its complaint, JP Morgan said VTB's lawsuit was a "flagrant violation" of its dispute settlement agreement in New York. The largest US bank said that US law prohibits it from paying $439.5 million, and VTB, in the event of a positive decision of the Russian court, will try to seize its assets abroad.
As Kommersant writes with reference to the court materials prepared following the meeting on April 22, 2024, the Arbitration Court of St. Petersburg and the Leningrad Region, at the suit of VTB, decided to seize funds in all bank accounts, including correspondents opened in the name of JP Morgan Chase Bank N.A. and nine other divisions. The court also arrested shares in the authorized capital of the Russian commercial bank J.P. Morgan Bank International, owned by JP Morgan, and banned the disposal of shares in the capital of the Russian subsidiary. The court also seized a number of JP Morgan trademarks and any securities owned by the US bank and other defendants. The Federal Tax Service (FTS) and the Interdistrict Inspectorate of the Federal Tax Service No. 46 in Moscow were involved as third parties in this case[1]
