2023: Losing in court to the Perm Ministry of Health, the need to pay 120 million rubles

The Arbitration Court of the Perm Territory recovered 120 million rubles from Medtrek for the supply of medical equipment not registered in Russia. The press service of the regional prosecutor's office announced this on October 19, 2023.

According to the supervisory authority, the contract between the Ministry of Health of the Perm Territory and Medtrek LLC was concluded in 2020. The contract provided for the supply of medical equipment intended for the study of patients in order to identify signs of early disease.

120 million rubles were collected from Medtrek for the supply of unregistered medical equipment

Under the terms of the contract, the company was supposed to purchase and supply 16 X-ray machines worth 7.5 million rubles each to the Perm Regional Hospital. Fulfilling its obligations, the supplier purchased the necessary equipment, which was paid for and distributed by the recipient to the structural medical institutions of the region.

However, after the goods arrived during its inspection, it turned out that the devices did not have registration safety certificates, were unregistered in accordance with the procedure established by law. The above arguments were confirmed by the state examination of Roszdravnadzor, the prosecutor's office of the Perm Territory said in a statement.

As a result of the audit, the regional prosecutor's office sent a statement of claim to recover funds from Medtrek LLC to the budget of the Perm Territory in the amount of 120 million rubles in connection with the supply of unregistered medical devices.

The Arbitration Court of the Perm Territory satisfied the requirements of the supervisory authority to recover from the defendant in full the funds paid. All supplied equipment was withdrawn from use in medical activities, the regional prosecutor's office said.[1]
