History
2025: Recovery by the court of Moscow ₽1 billion
The Arbitration Court of the Moscow District confirmed the decision to recover more than ₽1 billion debt and losses from the German software manufacturer PSI Metals GmbH and its three Russian co-executors in favor of the Pipe Metallurgical Company (TMK). The district court rejected the cassation appeals of the defendants on April 23, 2025.
According to Prime, the basis for the trial was the contract of 2019, according to which PSI Metals pledged to supply TMK and further accompany two software products: the integrated planning system (IPS) and the production process management system (MES). The Russian metallurgical company fully paid for the work, but in 2022 the German developer notified of the termination of contractual obligations.
The Moscow Arbitration Court in September 2024 considered the claim of TMK and recovered from PSI Metals and its Russian co-executors - PSI LLC, Progress LLC and Orekhsoft LLC - debt under the contract and license agreement with interest, which amounted to about €6.4 million or more than ₽42 million. At the same time, in the initial decision, the court refused to recover an additional ₽401 million spent by TMK on the implementation of systems, including the cost of wages of the involved specialists.
The Ninth Arbitration Court of Appeal in January 2025 changed the original decision, ruling to recover these additional costs as well. In its rationale, the appellate court indicated that had PSI Metals executed the contract appropriately, TMK would have incurred these costs as well, but they would have been offset by the receipt of functioning PIS and MES systems. Since the German company thwarted the execution of the contract, the cost of the wage fund became net losses for the metallurgical company.
At the exchange rate at the time of the decision, the total amount of recovery exceeded ₽1 billion. The Arbitration Court of the Moscow District, having considered the cassation appeals of the defendants, upheld the decision of the Court of Appeal.[1]
