2025: Refusal of the court to the State Fund to recover 160.4 million rubles of subsidies

In December 2025, the Moscow Arbitration Court refused to satisfy the claims of the National Technology Initiative Project Support Fund (NTI Fund) against Scan Aero LLC. The fund demanded to recover 160.4 million rubles of a grant allocated for the creation of a geophysical reconnaissance complex using unmanned aerial vehicles "Aerotomography."

According to CNews, in 2019, an agreement was concluded between the parties on the provision of a gratuitous and irrevocable grant for research and development (R&D). The initial amount of financing amounted to 123 million rubles. Subsequently, the NTI Fund revealed, in its opinion, violations in the spending of funds, including purchases from affiliates and expenses that do not correspond to the approved estimate. On the basis of an audit conducted by the project office of RVC JSC, the fund demanded a refund and went to court.

According to CNews, representatives of the court found out that the key evidence of violations by the contractor was only an audit report dated July 13, 2021. The court also found that the statute of limitations on these claims had expired.

The representative of the press service of the NTI Foundation announced the intention of the foundation's lawyers to carefully study the court decision. Experts in the field of law note that the chances of a successful challenge to this decision in the appeal are low.

Lawyer, partner of the law firm "Pleshakov, Ushkalov and Partners" Elena Yakusheva claims that in such disputes the courts strictly assess both compliance with the procedural deadlines and the presence of documented evidence of misuse of funds. In her opinion, the omission of the deadline could be associated with complex bureaucratic procedures characteristic of organizations working with budget financing.[1]
