2023: Tightening the deadline. 3 years in prison for unfinished polyclinic

The Perm Regional Court toughened the sentence of the ex-head of the Capital Construction Department (UKS) of Prikamye Dmitry Levinsky for abuse of power after the appeal of the prosecutor's office to the earlier sentence. The press service of the regional prosecutor's office announced this on January 24, 2023.

The court of first instance found the ex-head guilty of committing a crime under Part 3 of Art. 285 of the Criminal Code of the Russian Federation (abuse of office, entailing grave consequences) and sentenced him to a suspended sentence of 1 year 10 months of correctional labor with 15% of the state's income.

According to investigators, the accused in 2017, holding this position, on behalf of the authorized body, concluded a state contract with a commercial construction organization for the construction of a children's clinic in the Kirovsky district of Perm. According to the terms of the contract, all work at the facility must be performed by the contractor by November 2018, in addition, the clinic should have been equipped with medical and technological equipment. However, from the end of 2017 to September 2019, the official, realizing that the construction was lagging behind the planned schedule, while part of the work was not completed in full, the supply of medical equipment was not made, unreasonably signed acceptance certificates on the basis of which funds were transferred from the budget to the contractor. As a result of the unlawful actions of the accused, the budget suffered damage in the amount of over 29 million rubles.

The prosecutor's submission raised the question of the illegality and injustice of the court decision due to the excessive leniency of the sentence imposed.

The court of appeal changed the sentence, sentencing the official to 3 years in prison in a general regime correctional colony. Also, as an additional punishment, he is deprived of the right to hold positions in the public service and local government for 2 years 6 months.

In order to compensate for damage, the property of the former head was seized in the amount of more than 20 million rubles.

By the end of January 2023, the construction of the clinic was not completed, work at the facility was stopped.[1]

2022: Sentence - correctional work for accepting an unfinished clinic

In November 2022, the Leninsky District Court of Perm sentenced Dmitry Levinsky, the former head of the capital construction department (UKS) of the Perm Territory, to one year and 10 months of correctional labor in a criminal case on abuse of authority during the construction of a children's clinic in the Kirovsky district of the city.

As established by the investigation and the court, in 2017 Levinsky, on behalf of the SCUP, signed a contract for the construction of a polyclinic in the Kirovsky district, the object had to be commissioned by November 2018. The works were behind schedule. However, Dmitry Levinsky signed the acts of acceptance of the work to the contractor, realizing that in fact they were either not completed at all or not fully completed.

As a result of the unlawful actions of the accused, the budget suffered damage in the amount of over 29 million rubles. During the debate of the parties, the state prosecutor Oksana Kostevich suggested that the court appoint the ex-director the main punishment in the form of 6 years 2 months in prison in a general regime colony.

Levinsky himself did not admit guilt in the incriminated act, insisting that he had committed negligence.

At the same time, the Leninsky Court by mid-November 2022 is still considering another high-profile case against Levinsky. The ex-head of UKS Prikamye and his subordinate - UKS engineer Vitaly Gabov - were accused of embezzlement in the amount of million rubles million during the construction of a new Perm zoo. UKS acted as a customer at the auction for the construction of zoo structures in the Nagorny microdistrict. According to the investigation, in 2017-2018, Dmitry Levinsky signed acts on the acceptance of the work performed and certificates of their cost to receive budget money for payment. However, the work itself was not done. Levinsky is also accused of receiving a bribe in the amount of three million rubles - for this money he signed contracts with a specific construction company without the necessary procedures and patronized her[2]
