8 years in prison for embezzlement of 8 billion rubles
On July 14, 2020, the Dorogomilovsky court of Moscow sentenced Sergei Khachaturov for embezzlement of 8 billion rubles. The former co-owner of Rosgosstrakh was found guilty of committing crimes under part 4 of Art. 160 of the Criminal Code ("Embezzlement on an especially large scale"), part 4 of Art. 159 of the Criminal Code ("Fraud on an especially large scale" ") and part 4 of Art. 174.1 of the Criminal Code (" Legalization of funds ").
The second person involved in the case - the ex-shareholder of Rosgosstrakhbank Nadezhda Klepalskaya - was sentenced to six years in a penal colony. She was found guilty of aiding in embezzlement, fraud and money legalization. Prosecutors asked for nine years in prison for Sergei Khachaturov, and eight years for Nadezhda Klepalskaya.
In addition, the court jointly recovered from those convicted in favor of the injured party the amount of damage caused: Otkritie Bank - 5.77 billion rubles and RGS Assets - about 2.2 billion rubles.
The court found that Khachaturov, together with Klepalskaya and other accomplices, appropriated more than 18 thousand investment shares of the Nevsky Closed Mutual Real Estate Investment Fund, the actual value of which amounted to almost 2.3 billion rubles.
In addition, they fraudulently stole over 15 million shares of PJSC SK Rosgosstrakh, the value of which exceeded 5 billion 779 million rubles, and subsequently legalized the funds acquired as a result of the theft of shares.
The sentence to Sergei Khachaturov has nothing to do with the law or with real factual circumstances. This is an example of ignoring obvious and established facts in the process and their incorrect legal assessment. Moreover, the recognition of the owner as guilty of embezzlement of his own property is an open insult to the right, "Khachaturov's lawyer Alexei Melnikov told RBC.[1] |
The court commuted the sentence to Khachaturov - 4 years in prison
On October 16, 2020 Moscow City Court , he commuted the sentence for Sergei Khachaturov, who was previously found guilty of fraud and legalization of 6 billion, rubles as well as embezzlement of 2.4 billion rubles. The former co-owner of the insurance company "" Rosgosstrakh was reduced the term of imprisonment from eight to four years.
According to TASS, the Moscow City Court re-qualified Khachaturova's guilt from fraud and embezzlement to causing property damage by deception or abuse of trust (Article 165 of the Criminal Code). The court also excluded the article on money laundering from the sentence. As a result, Khachaturov may leave the colony on January 18, 2021, the agency notes.
The punishment was also commuted to the former shareholder of Rosgosstrakhbank Nadezhda Klepalskaya, who had previously been sentenced to six years in a penal colony on charges of aiding and abetting. The Moscow City Court reduced her prison term to three years probation with a probation period of four years. Klepalskaya was released from jail on October 16, 2020.
In addition, the court stopped the criminal prosecution of Khachaturov and Klepalskaya under paragraph "b" of part 4 of Art. 174.1 of the Criminal Code (legalization of funds) due to the lack of corpus delicti with the recognition of their right to rehabilitation.
Khachaturov was arrested on charges of embezzlement. According to investigators, a few months before the transfer of control over Rossgosstrakh to Otkritie Bank, Khachaturov and Klepalskaya re-registered more than 3.6% of the shares of Rosgosstrakh PJSC in the authorized capital of the Khachaturov-controlled company Technology and Automation LLC. Subsequently, these shares were sold to Trust Bank, and the funds received were stolen. After that, the investigation reclassified the charge to especially large-scale fraud.[2]
2021: Court increases sentence to 7.5 years
In March 2021, the Moscow City Court re-examined the appeal of the defense of the former main co-owner of Rosgosstrakh PJSC (RGS) Sergey Khachaturov and the general director of Technology and Automation LLC Nadezhda Klepalskaya to the verdict handed down to entrepreneurs in 2020. Two months ago, the IGU radically changed the decision of the court of first instance, dismissing one of the charges, retraining the others and sharply mitigating the sentence imposed on the convict. This time, the Moscow City Court actually upheld the first sentence, only reducing the terms assigned to entrepreneurs for embezzlement, fraud and legalization by six months: now Mr. Khachaturov has 7.5 years in a penal colony, Mrs. Klepalskaya - 5.5 years.
